Back from suspension-can I be dismissed?

Post by bingbong80 »

If I am asked back to work after a period of suspension and then charged with gross misconduct, can I be dismissed? Or does the fact that I am back at work suggest dismissal is not being considered? Worried sick. Any thoughts appreciated.

Lets not go into details but Gross Misconduct could lead too dismissal I would see your union rep ASAP if I went in and good luck.

It's hard to say without more info.
Though, I'd understand your reluctance to post too many details.
Gross misconduct can result in dismissal, even for a first offence.
But it covers a lot. What actually is the charge? What are you accused of doing?

If it is the same case, I'd say dismissal is unlikely. But new charges can be brought as a result of any investigation.
And previous conduct records are taken into account.

You could PM someone with more info, and may get a better idea of possible outcomes.
Sometimes, I wish I wasn't a Rep.

it would depend on what the suspension was for, though it would suggest that dismissal is less likely than it was when you were suspended, you get suspended to prevent a risk to the business, ie to stop you hiding mail, or to stop you bullying someone, so to lift the suspension and allow you back to work would suggest that this risk has diminished so as such a dismissal for gross misconducted has diminished as well, because if the risk was still there they would just keep you suspended till the conduct interview then dismiss you then

just dont count your chickens just yet though

The likelihood is you are not going to be dismissed , it is very rare to bring someone in from suspension and then dismiss. This is only likely if new evidence of a serious nature comes to light. You ar probably looking at worst a two year suspended dismissal.

may be worth asking for a 5 year suspended dismissal then atleast you know you will still be working
for royal-mail for 5 years.
