was out on collection Friday got out of the van twisted my ankle on a metal bar on the ground resulting in a bad sprain. took photos of the yard showed my manager who then went down to the business to look himself and said to me the yard is a disgrace. gone my Erica form with him and he has now turned it round to be my fault the accident happened nothing to do with the business leaving metal bars laying around with no signs up. I was wondering where I stand on this as am unable to go to work at moment and he has said its my fault

RM are not above the law if you had an accident then demand its recorded properly its not them who decide if its an accident or not. All this has come in under wcm and they are trying to cover up everything. Speak to your union rep or a solictor.

There's also the fun practice of conduct coding the person who had the accident.

If the CWU were half as successful at pushing people into the union as management was, we'd have 100% turnout on November 4.

have rung up the union accident line today and logged it with them so will go from there

my main issue is I want something done about the state of the yard I have to go pick up in I have mentioned it numerous times and nothing been done now I have had accident and rung the union up they might get something down

you need to fill out an LS 3 form and get in touch with the DWP and ask about an industrial accident form/registration.
Don't forget it takes 2 to tango, so while you have informed anyone who'd listen to the state of this yard you knew it was a dangerous place to collect from and were not paying attention.
However and this is a big however you informed anyone who'd listen and they did NOTHING, and the owners of the yard have a responsibility to ensure that their yard is a safe place to work in. If this yard is used by others then they too are at risk. Assuming you and others (outside of their own staff) use the yard every day and/or have continued to used the yard then the company, it is not unreasonable to assume, have condoned its use for the purposes which you and others use it for.
The big question here is what could my employer have done to stop this happening,well, you told them on numerous occasions and yet they still did nothing.

its a yard and up both sides is all the rubbish they don't want to pay to get rid of. there is enough room to get in and park up to avoid getting to close to it but on this day a metal bar had fallen away which resulted in me spraining my ankle. there are broken pallets scattered about. me a uk mail driver and dpd driver all complain to the manager of the business on a daily basis yet it falls on deaf ears. I have told my managers at our office all I get is they are a big customer we don't want to upset them and told I have to go collect

you need area H and S rep.
As you are instructed to collect, get pictures of the yard on days that you decide that it is unsafe to do so. Dont rely on the other 2 collectors cause they will not back you up.
We are required to make on the spot calls re H and S all the while. Support your decision with evidence

I took photos on day of accident and went down Saturday morning with a manager who also took photos. have forwarded these photos to my union rep who has passed them on to the area h&s rep

your managers "they are a big customer" speech is just that and not a decision. When you next speak to your manager about this, do so with a witness.
Be patient, if they launch into their "big customer" speech, let them finish and ask them for a decision.
