So your on a new duty ..... ,, but your confident you will complete .... but unexpectedly at the end of the duty you run into trouble with the duty (not your fault)and you dont have a phone meaning you will go half an hour over your time.Your manager does not pay overtime unless you have pre arranged this.

DO YOU

A) Continue working for free and just accept you are working for free and wont be paid overtime.

B) Return to the office and say there was not enough time and since you don't pay overtime therefore i wont work for free , manager/phg problem.

C)Do the work and if manager does not pay you overtime take them to a tribunal.

I can accept A and B but to take them to a tribunal for 30 mins overtime. Surely they would have to sack you before going to tribunal.

I'd deliver it this once (come and go as RM management keep telling us), and ask the procedures/managers will I get paid overtime if I don't forecast overtime and go over my time. If he says no, just bring it back in future. And make sure you rep is with you.

If there is a no overtime condition laid down by your manager, then he should have had resourcing discussions with the CWU rep and these should have been cascaded down to the office in advance of the coming weeks work, and all delivery staff should be made aware of what to do with overrunning mail prior to going out on their walks. The manager is failing in his duties and non compliant with the terms and conditions of the BT2010 Agreement if he has not had resourcing discussions with the CWU rep. I would suggest that you report any failures to the DSM for that area and also the Area Union Rep.

The manager cannot state a no overtime rule.He might get you to explain why you went over but he cannot refuse you overtime so it's a bit of a daft question.

If no authority is provided to work overtime then they will not be paid . that is the managers stance and are prepared to go to ET over it .
We are advising him to continue with his claim at the tribunal

I dont think you can win that in court then again it is an industry with variable duty times and sounds a bit tight from royal mail, would be pretty weird if RM would let it get that far to be honest with you. expecialy over what? 30 mins?

Plus how does it make sense paying lawyer fees over a fivers overtime

One of our lot brought a bag back a few weeks ago after the lino said there would be no overtime paid, and he was suspended. The lying scumbag lino also said he told the OPG to strip any attendance call packets out of the bags, which was a blatant lie as the OPG's partner was standing nearby and never heard him say anything of the sort.
