Should you quit before you're sacked

If you're up for gross misconduct such as cuaght in possesion of a dodgy tyre ?

The rep says 'no chance' of not getting sacked, so its really a pensions question.

Do they nullify the pension and if so can you stop that happening by quitting before they've actually sacked you ?

Also, would you still be able to get a reference, and have no charges once you've left? does the investigation cease?

The DoM is still going through the motions and I hope I can cut and run.

Either way, its been a pleasure to be a postie and this site has been the icing on the cake.

1. checked tyres for tread = o.k 2.inflated tyre. 3.noted abrasion noise @ over 40mph. 4.pmt'd as axle/transmision. 5.turns out its a crack in the back of the tyre. Ferfukksake.

I think that's bollocks.

You have PMT'd the van, and therefore are not responsible.
You are not a mechanic, you knew there was a fault, you didn't know what it was, you don't have the qualifications or the training to know.

If that van has gone to the workshops, and they looked at it, decided it wasn't what you thought, then they should have looked for and resolved the actual fault.

You're only problem is that maybe you wrote down a problem on the PMT form. Unless you KNOW the fault, describe it/what's happening.
If your Rep is serious, he's a knob too. Get in touch with Area Rep (if it is them dealing with it already, Branch Secretary), and the Area H&S Rep.

You're required to check the tread and the inflation, if they're OK, then I don't think your manager has a leg to stand on.

As far as pensions go, you keep your contributions, but RM can (I believe not always) take theirs back. If you resign, I believe you'd keep them.

there`s no sacking offence there at all pal. as has been said, take this up the union chain until you find a rep who know`s what he`s doing. If your DOM thinks he can sack you for that then he`s even dumber than the rest of them.

Thanks, I'll maybe hold fire a while. Still interested to know at what point you can just walk away with no pensions/reference/employability liabilities.

in the last month or so we have had a driver drive around with a flat tyre for 80% of their rural walk and another one whose leaf spring snapped clean in half and still drove the van back to change it rather than wait for another van / RAC.

is it your van?

has your rest day cover driven your van?

has anyone else driven your van?

if they have and it's not been reported then they are as culpable as you are.

don't worry yourself about it, it is in no way a sackable offence, in fact have you been shown how to check your van over on a daily and weekly basis? nope, did'nt think so ;)

like what was said before my post, get a decent rep on the case, if yours is not up to much cop get the area rep involved.

The only time your pension is at risk is if you have been dismissed,charged,prosecuted and found guilty of theft.
In those specific circumstances Royal Mail have the right to attempt to recover losses directly from your pension fund.
Other than that your pension is safe whether you resign or are dismissed.

If it is then there would be no way the postie checked the tyres!
