Should you quit before you're sacked (reposted)

If you're up for gross misconduct such as caught in possesion of a dodgy tyre ?

The rep says 'no chance' of not getting sacked, so its really a pensions question.

Do they nullify the pension and if so can you stop that happening by quitting before they've actually sacked you ?

Also, would you still be able to get a reference, and have no charges once you've left? does the investigation cease?

The DoM is still going through the motions and I hope I can cut and run.

Either way, its been a pleasure to be a postie and this site has been the icing on the cake.

Sacked for a dodgy tyre? Wtf that wouldn't even get a warning in my office.

Only quit if you can afford to feed yourself, as if you do you won't be able to sign on for 6 months. I wouldn't quit at all anyway unless you have previous warnings, what exactly did you do?

Edit: Just read the original thread, that is complete bollocks. Do not quit, if they sack you at the hearing take it to tribunal because its ridiculous. I'm telling you NOTHING would happen to you for that in my office.

Thanks, I know nothing of due processes since I have a clean sheet but its the pensions and 'cut 'n' run' benefits/possibilities really, so at what point could you just 'get the hell out of Dodge' with integrity, pension and employability still in tact?

You wont get sacked over a tyre. The worse you will get is a temp driving ban.

Two guys in my office have been caught with bald tyres neither have been sacked, do not quit your job, have your managers provided you with the proper equipment to do your vehicle checks for example a gauge to check tyre tread depth

There's no way you get sacked for a dodgy (I presume you mean bald) tyre. Get the rep or area rep onto the case!

someome at our office got a 2 year suspended dismissal for a bald tyre a few years ago

I check my tyres and all the the other van checks they ask for....everyday.
I have no idea whether they are dodgy or not......i have never been trained in any sort of van maintenance....any irregularities would have to be glaringly obvious for me to spot. Anything borderline and i would be struggling. Pretty sure you cannot be sacked ,on a gross misconduct charge, for being unable to adequately carry out a task you have had no training in ? Surely, a reprimand, counselling and training by a suitably qualified person would be the outcome?
I accept that a really dodgy tyre would land me in trouble with the law.... and that's a risk i take, even in my private vehicle.....but i am about as clueless on car maintenance as is possible to be. I rely on other folk to warn me if i have a dodgy tyre....sad,but true.Don't get me wrong, i try to keep on top of it, and am pretty sure i would spot an illegal tyre, but i cannot guarantee it. But if i do get pulled over, i will get a fine, and will be my own fault. That's the punishment.....dished out by the law of the land.
But gross misconduct?......think they would struggle to make that one stick?

You can quit whenever you want, until they officialy sack you, itll be classed as quit. I wouldnt bank on a good reference though. If they advise you to quit, then dont, as the case is as strong as mr bean
