Break at end

Post by veronihilverius »

He was forced to take his break at the end of the duty when its procedure and policy to take in the middle and he has this in writing from royal mail management to take break at the end , after his duty. He was also only being paid 20 minute for break when it should of been 30.These problems resulted in him losing his job.

The intended effects of a policy vary widely according to the organization and the context in which they are made. Broadly, policies are typically instituted to avoid some negative effect that has been noticed in the organization, or to seek some positive benefit.

in that case from a legal stand point with regard to working time regulations and rest breaks his attendance length is less than 6 hours so is not entitled to the legal minimum break of 20 minutes, as such as Royal Mail have given him a break that by law he has no statutory legal right to, therefore they can dictate it be take at the end of his shift technically and they would still be in compliance with the working time regulations.

It would be outwith collective agreements that RM has with the CWU however but whether he would get any thing from that in court would be a different matter

what is the actual point in the cwu agreement that states breaks must be taken during and not at the end of the duty?
Null and void?

1. Having no legal force; invalid: render a contract null and void.
2. Of no consequence, effect, or value; insignificant.
3. Amounting to nothing; absent or nonexistent

But is it still a company procedure that has to be followed ? And if it is not therefore breaking company policys.

Wrongful termination happens when an employee is discharged from employment because the company policy has been violated in connection to why the employee has been fired.

The Way Forward is a Collective Agreement.
Your contract of employment explicitly mentions the inclusion of collective agreements.
This means that all valid collective agreements are express contractual terms.
Breaching those terms is a breach of contract.
