Stage 3 Triggered Incorrectly?

Hi

I triggered a Stage 3 warning in April this year but because I'm
under the DDA / Equality Act for kidney disease, several absences were
ignored on advice from ATOS.

My manager told me that I 'must have won the lottery' as my record had
now reverted back to a Stage Zero and I was in the clear after winning my RTU.

I found out today that I have now triggered a further Stage 3 warning as I was off in July
with an asthma-related illness.

HR have said that one of my illnesses which triggered my previous Stage 3 in April
contributed towards this new Stage 3 but this is nonsense as it was incorrectly recorded as
'Lower Back Pain' at the time when it was renal colic, caused by a UTI kidney infection.

I find it staggering that I can be told in May that my record is clear, only to trigger a further RTU because of one single absence in July.

Can anyone please advise? Thanks.

You really need to sit down with your rep and go through your sick record.

Maybe worth mentioning though, that asthma can also be considered a disability under the equality act.(ATOS reports?)

Also are you saying that you have gone from nothing to stage 3 since APRIL?

would need to go through all the details, which is why you need to talk to your union rep.

Exactly right. Got a letter from the DOM informing me that the lower back pain (kidney infection, April) was covered under the DDA and would be discounted, along with five other absences related to my kidney, thus reducing my stages to zero.

So I've gone from 0-3 since April because of a huge error somewhere!

Yeah, you definitely need to go through your sick record with a your rep, you should get a copy before any stage warning interview.

This will show you all your absences and dates and stage warning triggers etc.

I would hardly compare suffering with kidney disease to winning the lottery...what an idiotic thing to say,but what we have come to expect from the managers.
