breaks
Hiya i have a few questions that i hope that can be answered by sum one like cwu or anyone with good knowledge of the job possibly some kind of agreed document.
1.I have a 27 hour contract and my break is 20 minutes is that right? or should it be 30.
2.I start at 9 and finish at 2 but the manager said i cant take a break in the middle only at the end i could really do with a break in the middle because i get hungry and exhausted.
3.The manager said he wont pay overtime if i come back late if its been busy and i have to tell him first so he can accept me doing overtime or not how am i supposed to know ive often gone over my time but he refused to pay me overtime but sometimes i dont go over i cant explain why , sometimes its to many recorded letters or the d2d seem to take forever to fold? should i just come back with the mail because i wont be paid? i dont get it
Thank you

Re: breaks
Taking a break at the end of your working day is illegal! tell him to get stuffed!2.I start at 9 and finish at 2 but the manager said i cant take a break in the middle only at the end i could really do with a break in the middle because i get hungry and exhausted.
https://www.gov.uk/rest-breaks-work/rul ... ing-breaks" onclick="window.open(this.href);return false;
2. Rules for taking breaks
Employers can say when workers take their rest break during work time as long as:
the break is taken in one go somewhere in the middle of the day (not at the beginning or end)
the worker is allowed to spend it away from their desk or workstation (ie away from where they actually work)
won't pay you overtime? then don't do overtime simple3.The manager said he wont pay overtime if i come back late if its been busy and i have to tell him first so he can accept me doing overtime or not how am i supposed to know ive often gone over my time but he refused to pay me overtime but sometimes i dont go over i cant explain why , sometimes its to many recorded letters or the d2d seem to take forever to fold? should i just come back with the mail because i wont be paid? i dont get it

Re: breaks
Yes i know but i have asked him and he has stated even in writing to me that the break MUST be taken at the end of the duty .I have told the cwu about it but they are not doing anything.
Thinking about resigning and suing them as it is effecting my health.

2 your manager can't dictate that you take your break at the end of your shift. It is actually contradictory to everything I have read regarding when breaks should be taken. Personally I would take it whenever is least convenient for your boss as he is obviously a lying underhand twat.
3. Get your rep on to this, if you're fairly new it is no wonder that it is hard to gauge how long a walk with all its attendant variables will take. Don't just bring it back, you open yourself to all sorts of conduct issues.

Re: breaks
In 8 months I've never taken a break. I've also been told to take it at the end, that would mean me finishing at 1.30. If I took a break all the post wouldn't get delivered within my time. That also goes for most people in my office, there just isn't enough time to take a break.

Re: breaks
There is a grey area though. If you are working 9 - 2 - then thats a 5 hour day and under RMs rules you are entitled to a break

However, you are not entitled to a statutory break under government legislation (you have to work, or be expected to work 6 hours) and therefore the rules about when it should be taken may not apply.
If your rep ain't helping then get the Area Rep involved, if you are a member you are entitled to get answers from Area if local isn't doing it.
As to cutting off/going over - Your boss is being a tosser, but he is right. There is an agreed procedure - its called Overrunning Deliveries OPG Notification Procedure http://www.royalmailchat.co.uk/communit ... =2&t=18563" onclick="window.open(this.href);return false; - have a read of that.
Basically of you think you can't complete in the given time then inform your manager and let them make the decision. If you don't know how much you can complete or how long it will take then tell them. Even if you do agree a time, place and you will still go over then come to an agreement when the manager or you should make contact to review the arrangement.

Re: breaks
Ha ha yes true but then you risk a bollocking when you get back to the office. Not so bad if you've been there donkeys years and are on a permanent contract, but when you're only on 3 month rolling contracts and you've been there less than a year you feel the pressure big time.Sidley wrote:There is always enough time to take your break, delivering everything on the other hand.....

Re: breaks
As to the break at the end and feeling tired and hungry - you could use the H&S card to get that changed.
