Meal Breaks Rural Deliveries

I know this is an old issue but we have a DSM who makes lads on rural deliveries have breaks in their vans.
Their other alternative is to return to Depot and have meal there.

Can anyone tell me policies and a procedures regarding where you can have your meal break.

I believe as long as you are not going off route and vehicle secured you should be able to go to a cafe or even home if your delivery passes your home.

The DSM has said you can park outside your home and wife bring meal out but you cannot go in for security reasons.

Help let me put this idiot in his place.

The regulation states that you are entitled to take your break away from your workstation. As far as I'm concerned once on your outdoor element, your workstation is the vehicle.

The best way to put the DSM in their place is to return to the depot and take the entitled meal relief. Once finished return to your break off location and if as a result of this you are unable to complete delivery inform your Manager within the guidelines for doing so.

. As mentioned in a recent post .We have now been told (only told if we try booking overtime , that they will assume we have taken a twenty minute break at some point during the day . The law states you must be entiled to have a 20 minute uninterupted break every six hours (minimum).

there are exceptions .. which includes postal workers, airports etc , if there is a sudden influx of work you can be asked to work througfh it (such as a lorry turning up or an aeroplane lands then the baggage handlers must unload it...

Your employer is also responsible to provide you with certain things for your break ..first is a falt clean surface to eat off of and a chair with a back----no flat CLEAN surface in any van i have seen

Tell your boss that you are unwilling to take your break in your van.
That you will take your full 40 minutes break before leaving. When you have to start breaking off to deliver Specials before the 1pm deadline, and as a result have to cut off and bring back some delivery, his attitude may change.

Get the Rep and Area Rep in. Ask to see the relevant document/agreement that states you have to take your break in the van.

Where an attendance is provided with more than one break, the second break may be scheduled at the beginning or end, in which case attendance is not required solely for booking on or off. A single break should not be scheduled at the beginning or end of the attendance.
