ATOS over ruling seneroity
Hi all,
i need some advise asap.
I had a chap whose been most of the duties trying to get one that suits him with his bad legs, he got help to complete etc but still couldn't do it.
So ATOS, RM and CWU(area rep) decided to put him on a rural, by shifting someone else off. That starts next week. He is FT.
But today i was told another chap has been recommended by ATOS for a rural and needs trained he is PT.
I know the guy well and he has been doing his best with bad knees, but i'm sorry i don't see why people should be moved to accommodate them?
we only have 10 rurals whose next?
Don't get me wrong they have a right to a job the same as next man but to move someone else to achieve that is wrong.
They can have reasonable adjustments made, i count this as unreasonable.
Any help would be much appreciated.

I agree......
Until my knees give up and I need an easier walk.
I don't know if it's true, but I was told that post revision offices that have had a resign means that even though you may have signed for a walk, it's not "yours" for life, you can be moved off it for "operational" reasons.

Re: ATOS over ruling seneroity
I don't have an issue with seniority generally mainly because there isn't really a better option but threads like this make me think twice.
Ohh the bad men want to move me off my cushy duty and give it to someone with f****d up knees.
Ohh the injustice of it all.

Hi Fishtank, it's not meant like that, i think that anyone who genuinely is at a disadvantage should get all the help they can get.
So you have posties that have been on a duty for 10yrs+ and they can be moved without notice or consultation because ATOS says so?
But my main gripe and my members is a PT taking a FT position above others who have been there longer
Our rurals are anything but cushy, yes it may be easier for them i.e. less walking, less stress on the knees.Ohh the bad men want to move me off my cushy duty and give it to someone with f****d up knees.

Re: ATOS over ruling seneroity
Yes because ATOS are backed by the Equality Act and if this member has a disability the business must make reasonable adjustments to allow that member to continue working and if the business and ATOS agree that a rural delivery would meet those obligations then that's what happens.beanmuncha wrote:So you have posties that have been on a duty for 10yrs+ and they can be moved without notice or consultation because ATOS says so?
These aren't our duties,Royal Mail allows the allocation of duties by seniority but it doesn't sign the duty over to us.
This is a more tricky position. But my main gripe and my members is a PT taking a FT position above others who have been there longer
Rurals don't particularly suit part-time so continuing to work part-time hours may not have been possible,Reasonable adjustments alone should not be used to increase hours but in this case it may have been unavoidable.
One solution would have been to allocate the indoor work to someone else through seniority, another would have been to "job share" the rural with another part-timer and resource the full-time job elsewhere.
Without knowing whether these options were explored with the member, rep and manager I don't know whether the correct process was followed.

I can assure you that my knees will be more f****d up than the next person's if the 'Bad Man' is gonna sort me out with the best duties.
where does it end and what price loyalty over lazyitus.

'reasonable adjustments' to a duty for the benefit of a disabled person, not to the detriment of someone else.
where will it stop, and how far is it reasonable to spread this net. in the end only disabled people will be employed 'cos all the good uns will be moved and leave for a job where loyalty and goodwill is supported. and now lets round up all the raspberries on a coach take em to the Mail Centres and get all the four limbed persons out on any old delivery despite circumstance.

1. Your definition of "lazyitus" suggests you have medical training, are you my manager?thebiggestman wrote:where does it end and what price loyalty over lazyitus.
2. Just because you would abuse the system doesn't mean others do.
3. If many more duty holder start crying because they are moved out of their comfort zone I suspect it will end with Royal Mail scrapping seniority altogether, they must already be wondering if it's worth the grief.

That comment is pathetic.thebiggestman wrote: and now lets round up all the raspberries on a coach .
It is childish
It has no place in this forum.
You are a dick.

Where do you get only disabled people will be employed from?
Most people in Royal Fail land who become disabled are shafted out the door on `ill health retirement` bolloxs,if they are not shafted out of the business by corrupt managers they are bullied and intimidated by crass people who are only too willing to f**k somebody off just so they can run to the conference south league table of seniority and remark "Well that's me up a space"
Royal Mail is notoriously crap at making adjustments even one of their own web pages admits this:http://disabilityequalityprogramme.com/ ... upport.htm
"A comprehensive review of the support given to disabled employees was conducted in 2008.
The time take to deliver reasonable adjustments was taking in excess of 87 days. A number of employment tribunals were lost on the grounds of failure to provide adequate reasonable adjustments.
Disabled colleagues were not getting consistent support across the business."
Even now some 5 years on from this and some 3 years on from the Equality Act they have managed to cut the time taken to make adjustments(if indeed they even do
Royal Mail managers.....about as popular as a t.urd in a swimming pool!
The DDA/Equality Act demands action,NOT words......adjustments NOT Occupational Health referrals.Case No:2505901/09
Royal Mail is an Equal Opportunities Employer..It discriminates against everybody.

Re: ATOS over ruling seneroity
The problem when you've been long term sick is do I return if possible or do I take ill health retirement, It's often a case of damned if you do and damned if you don't. If you return Royal Fail see you as no more than a pain in the arse and if managers can get one or two posties to join in that's even better, Just look at the difference of opinion on here. You could go to the Union but they are people and as such have a difference of opinion themselves and I've heard it at different levels from rep to region and quite frankly some times it's been shocking so you say to yourself if I needed a union man would I get a caring chap or a piece of s__t like Ian Duncan Smith. Then there's the final option IHR and that's probably why they take it . Personally I'm not a saint but I try to back anybody with a disability and always will I don't like bullies e.g. RM management , the Government oh and the I'm alright Jacks.

So the I'm alright Jack is a bully?
And as a walk is a walk is a walk there's no point in moving someone onto another walk so the only option is your indoor duty. Now most of these are held by loyal (maybe exPHG) long serving, coming to the end of their career persons. And mr two years can't do the job/ be bothered can be moved into that job? So now we have a re- sign of all the other duties just to be fair and then we open this method out to the whole area, region country. Get real. Like any other walk of life if REASONABLE adjustments can't be made you can't do the job you were contracted for then move on -circle of life
