Cwu help. Bullying and harassment/blackmail?

Hi guys im new to this and need some info/help.

The situation is i was offered a 39hr full time leave reserve contract. I have 2 witness's that heard the DOM offer me this job. Last weekend i rang in sick and apprantly i was seen at macdonalds (a man has got to eat).

So today i asked the DOM when i was going to be put on this contract and his answer was and i quote "going to wait 2 weeks until we sort out this situation with you" surely he is making decisions on the basis of my attendance.

Just need some help as this is the first workplace i've worked at where bullying is coming from managers/Dom's

Why is that stupid, before I joined RM a man I knew was off sick and worked in Mcdonalds, the particular branch was less than half a mile from the companies offices, and the branch his managers would have used, another was a cashier at the local petrol station.

if i assume that the "situation" was you being at Mc D's, you are right, people have to eat. This is not a "situation".
2 weeks is the excuse and hope you go away, the "situation" is the vaguely referred to reason. get your witnesses to commit to the offering in writing, and then go ask the DOM again. if he/she persists with their previous stance get your union involved.

I have got the union involved but they walk all over him and its like he is scared of them.

the angle is that you were offered a job maybe that you should have never been offered.
what happened when you went to see your DOM about the offer and the 2 weeks situation thing?

If a full time reserve job has become available in your office it should be advertised in the office and offered on a seniority basis to the most senior part-timer who applies for it.
If that's you then you should get it,If it isn't then you shouldn't and the union cannot help you.

No it's not.
There is nothing in the conduct code,attendance procedure or sick absence policy that says you cannot leave the house if you are off sick.
You are off sick because you are not fit for work,not because you cannot lift your head off the pillow.

If you were a vegetarian like myself , there would be no problem lol.
Joking apart though it should be advertised internally and be given by seniority , although RMM do not follow there own procedure , at my office new starters were coming in on higher contracts than myself and others already employed part time , this went for over a year and was resolved two days before my employment tribunal case was due to be heard.

Yeah i was the most senior that applied. RM did the whole thing properly.

Ive had a fact finding interview about the situation. What is most likely to happen i get a stage 1?

fact finding is from the conduct code and stage 1 is proper to the attendance procedure. So which code were you interviewed under?

Bad enough if it was the DOM himself who saw you eating and decided to make an issue of it. Eating is necessary and there's little difference to popping to Tesco for a tin of beans or having fast food. In fact you could argue the McDonald's approach is more logical and sensible because it takes less effort. But if it wasn't the DOM but someone else who saw you and thought it worthy of passing on, I despair. How do you look yourself in the mirror knowing you've snitched on somebody for eating. Not riding a f**k**g unicycle whilst juggling kebabs and singing the national anthem. Not wire walking across the Grand Canyon like that fella on TV last night whilst stuffing your face with jumbo hotdogs. Just sitting down (presumably), having a meal. Like people do.

I'd like to drag these twerps through the courts and give them a good grilling ............... if you'll pardon the pun. What is the issue here. Are you off sick because you've told them you've had your mouth stitched up? Of course not. Would not eating help your ailment? Wouldn't have thought so, starvation isn't the cure for most afflictions. Is eating in McDonalds seen as particularly strenuous? Well only if you have to cuff twenty three unruly teenagers out of the way or you need a wheely bin to collect your order. Maybe you had to cross three mountain ranges and a couple of croc' infested rivers to get there? No ??

There is nothing to answer for here. Eating is necessary like I said. Maybe the DOM gets by on a litre of unleaded and a shot of oil but even he'd have to pop to the garage once in a while. The rest of us need food. As for the snitch, hope he gets e coli in the very near future, g*t.
