Is the ballot legal enough for a strike

Title says it all really, having not seen a ballot paper was just wondering is there any grounds for RM to contest whether or not the ballot is legal, enough to call a strike on, as it was a consultative ballot and had four items on it, could they claim it wasn't legal.Wouldn't be the first time the union had screwed up a strike ballot.

It was not a Strike Action Ballot therefore NO Industrial Action can be taken on the back of it, only political action. If any action was taken it would be illegal.

So the simple answer to the title is NO.

totally agree with your rationale TBT but what was it about this Consultative Ballot that RM went running to the High Court about? and got an injunction over the Union NOT being able to take strike action in the next seven days? Bit confusing really

Hope royalmail get the costs of this awarded against them even if they win this ballot was a consultation as such I hope those who took our union to court be made to pay the true cost out of their salarys and pension pots!.

Their for we need our union to make this point about the waste of public money on legal action on a ballot which never was intended for I/A.

A mixture of:

1. They panicked and/or over reacted.

2. They thought the CWU was more militant than they actually are.

I was surprised at RM going to the court, not least of all because it made a mountain out of a molehill and drew attention to the fact that there had been a ballot and that a possible industrial action was on the cards in the not too near future - poor reaction by RM and a great bonus for the CWU.
