am assuming you mean people who have some how already finished and left before you and signed out at 1420, even though you yourself are signing out at 1350.

Under time - as in overtime, but in reverse. If we are 30 minutes under our time we have to state it.

Fraud.....someone not taking a break, but when they are signing out, they say they are finished later than they actually are. I don't mean 10 or 15 minutes, I mean over an hour.

1. Yes - its called falsifying documents and can be classed as Gross Misconduct.

2. Not sure what that means but there would be 2 issues here.

a. On the face of its the same as 1.
b. If its to do with banking hours then as that's not agreed not sure if it could be counted as fraud.

How about if you don't take your lunch break? I work until I finish. Then when I get back to the office I add the 30 - 40 mins break to my final finish time. Normally ends up I have worked to my correct time allowance.

Technically, its wrong and might be construed as fraud. The reason I say might is that there is a statutory break of 20 minutes that should be taken in the middle of your working day (paid or unpaid). So RM could, although I don't think its yet happened, reasonably claim that they believed you had taken your break at the prescribed time therefore making your addition of 20-40 minutes on top of your actual finish time fraudulent.

I wouldn't like to be a lawyer trying to sort that mess out, which is why I always take my breaks whether 40 or 20/20 during the working day rather than at the end. You finish later, but it doesn't store up problems for later on.

Since we have no agreement to use the signing on sheet as a record of "under time" and no agreement to pay back "under time" then it isn't fraudulent.
It's actually failure to follow proper procedure.

don't know about not being insured, however it does seem highly likely that if this event/accident was fatigue related and in your statement you said you had not taken a break there may be some room for manoeuvre for RM.

ever since RM decided to make us "work every minute" rather than give us job and finish incentive its like this. All trust and goodwill between workforce and RM is gone.
