Fact finding interview and evidence disclosure?

Fact finding interview and evidence disclosure?

Ok

A colleague in a nearby office has a serious allegation against themselves to answer, they have a fact finding interview at 48 hours notice. Now the colleague has asked me about any evidence that said line manager/Dom will be gathering, or will have gathered or even attempted to gather

Due to the nature of the allegation, once any evidence is revealed my colleague will know whether this allegation is true or false. (It's not stealing, or anything fraudulent)

I know that a fact finding is simply questions to gather facts :nervous

But at what stage would a manager disclose any information to us?

I can't say much as our cover will be blown , such a great company and all :left:

Hi there,

from what I've seen of some conduct cases where Investigations Branch was not involved, the words 'balance of probability' were used by the manager.

The 'evidence' was witness statements. Witnesses were hand-picked.

Sometimes the manager had already decided the outcome and was choosing what 'evidence' would fit and ignoring what might mitigate.

I've been involved in a case where managers changed a person's statement, who then signed it, feeling intimidated to do so.

My experience of this is limited and I've heard of reasonable managers too, so hope for one of those.

should the firm decide that there is enough evidence to pursue it.

All evidence SHOULD be disclosed at the fact-finding, then the chance to respond, then decided whether to go Formal or not, and yes 48hrs is correct :wave :wave
