What do I do now ?
Last December during Christmas pressure I took out a B&H grievance against another bloke at my DO, due to the weather and Christmas this wasn't actually dealt with until January, the result was that the grievance was "partially" upheld, ( still don't understand it).
In the February the bloke was still working in another office, and was told because the case was over, RM would no longer pay him travel expenses, but he wasn't allowed back to the DO until he had completed the things advised. So instead he joined the Union ( he always bad mouthed them, and only joined when he wanted something) and filed a grievance against me, this was in mid-February, I was at the time off sick with arthritic pain in my knee, on my return to work, I was told that I wasn't allowed back to my DO, because of the grievance taken out against me, that grievance was fully upheld, but is a pack of lies, as the blokes own statement is completely different from what he said in the original interview, one of the results was that I should be conduct coded.
During my time off sic I was given a dismissal interview, and formally dismissed with four weeks notice, pending appeal, I left RM employment on 12th April, on the 8th May I had my appeal hearing and was advised on 15th May that I had been re-instated.
My Manager contacted me and told me that I had to re-start work at a different office to my DO, because the conduct code hearing had still not been held, on the 16th May my Manager gave me a back to work interview, where I was basically told in no uncertain terms that my depression would now be taken into account when assessing further absences, I asked about the timing of the conduct code, and was told in no uncertain terms to put up and shut up " as I had been noticed" and "was making waves".
It's now June 10th, because my parent office is one of three managed by the same manager, I am finding myself being moved around the other two, put on duties I don't know, with no training, I was promised a roster, but I'm being given less than 24 hrs sometimes of a change duty or DO.
I've asked about my conduct code and have been told "it is being progressed"
The moving around is the biggest problem, I get put on frames I don't now, it's OK with the mech most of the time, but the IPS takes me ages to sort.
Today I was shoved out on a walk with a trolley and a map, when I wasn't back by 1400 apparently the PHG came out looking for me because the person normally finishes the walk by 12:30, and he expected me to be back.
I'm getting stressed out on the walks and the continual changes, when I can't find a house I get really stressed.
I just want to now what I can, if anything, do next, do I have to put up and shut up, is there no recourse to get the conduct code sorted so that I can back to my parent Unit ?
I've also found out that my parent unit is now going through it's own revision, so there will be a resign, and if things are not sorted I will lose my seniority in my own DO.
I need good advice on this please, not conjecture or hearsay.

Blimey what a mess
Contact your area rep, get him/her on side and explain what you have been through etc
.
You could try the depression angle, clouded judgement etc. See if you can bury the hatchet with the guy you had the orig problem with and both of you work something out about the grievance's .
Best i can do.

The Union know all about it, and say they cannot do anything to force the issue, or to make RM hold the conduct meeting, I get the impression I'm victimised to make me leave.krussel wrote:Blimey what a mess![]()

Re: What do I do now ?
I presume when they investigated your B+H case that they gave you all the paperwork and how they came to their conclusion to `partially` uphold it? Make sure you keep hold of this!!
Reading between the lines,I wouldn't be surprised if the guy you've complained about is a big mouth and possibly a bully who has managed to manipulate the union into bringing trumped up accusations to cover his back, and Royal Mail has also jumped on this as we(people who have been through this, or defended people)know that they don't like posties who bring B+H cases or grievances,(Which is backed up wth your statement to "Put up or Shut UP")
It really seems to me that your walking around with a `target` on your back and that Royal Mail are trying there best to get rid of you by anyway possible by pissing you about and disregarding your depression, reading again between the lines I also think that somebody, be it a senior Royal Mail manager or Royal Mail Lawyer has realised that they might be on a dodgy wicket and that's why they reinstated you in the first place.
Personally I can see where this is going
,but it is up to you how you want it to play out.

Re: What do I do now ?
Personally, if I were you and sounding like all the things you've gone through, I'd go on long term sick and look for another job and get the hell out of there.
But in the meantime I'd definitely get the union involved, go higher up the union if you don't get the answers or resolution you are looking for.
Also the possibility of suing them, I'm not joking either. A lot of what you are saying could be deemed constructive dismissal.

Re: What do I do now ?
Well the latest news is that at 7:30 am this morning I was told by my manager that the conduct code would be heard tomorrow morning "early", I contacted the Union rep, and he said they had to give me 24 hrs WRITTEN notice, the manager disputes this and says it will go ahead, so I've spent most of the afternoon and evening preparing may case, hoping the Union rep will turn up, if he doesn't they've said the office rep will have to sit in instead.
I'm not sure about going long term sick, I don't know what would be worse, being at work, or having the missus moan at me every day

Re: What do I do now ?
This just carries on, now into July.
Had the hearing four weeks ago, today got another letter telling me I have to attend a conduct meeting, to answer to being charged with Gross Misconduct, that I used threatening and aggressive behaviour towards a colleague.
I'm to be aware that one outcome could be my dismissal.
This company is really a joke, they put me through the dismissal process for being off sick, which is found to be false, now they are believing a bloke who brought a counter claim against me ten weeks after the event.
I just can't win, I'm now on light duties after twisting my knee at work, an accident I know my Dom hasn't done the Erica report for, I was told at a previous hearing that I had to make sure it was done, how the heck do you MAKE a manager fill out an Erica report?
I've reached the point now, where all the good work done by the mental health service has been undone, and I just feel like killing myself, it's just so stupid, they haven't even interviewed the people I asked them to, I get the impression I'm victimised and forced out, simply because I took out a B&H case.
My Union Rep said today that they were aware that RM were holding on to this case, rather than seeing it out before my previous dismissal hearing

Re: What do I do now ?
Get your H&S rep on to this. The Erica should have been completed straight away.
Failing this get your area H&S rep involved. Its not good enough.

Try and keep your chin up buddy, what goes around comes around.. some of these gestapo style managers may have a wake up call come privatisation.
I'm also of the belief this industry is overloaded with conniving scum bags who call themselves DSMs & DOMs who are given the green light to bully & harass any person they wish in a manner they deem fit.
Shame on you moya

Re: What do I do now ?
This can be closed now, I went to the meeting today, put forward my case, and came out of it completely exonerated, with a clean record, at last I got to speak to a manager who saw sense, and realised the whole thing was a stitch up.
I can now chill out, get on with my job, and just post bloody letters.
I know one thing though, I will never ever go through the B & H procedure again, this experience has put me off for life. And the crux is, that isn't how it should be if RM really want to stop B & H in the workplace.
