Hello,

Ive lost my previous account on here but a quick update, after 2 years of going through s**t i have won my bullying and harassment case. I now have managers and fellow staff telling me to take RM to a tribunal.

How do I do this? i have spoke to lawyers but they want £200+ an hour.

Is there a guide for this procedure?

What is a ET? Basically ive had to take time off sick, due to this case and bias by the Royal Mail i have to go to the hospital every fortnight for physical and mental counseling. The bias shown by the RM in my bullying and harassment case (Case took just over a year to complete due to the lack of professionalism by the RM staff)

as far as I know you won't get anywhere if the b & h is over 3 months old. If you can, ring simpson & miller for advice and go from there.

If you tried to take this to a tribunal RM lawyers would say it is out of time.You could if there are many incidents up to the present day, try to say it is ongoing and therefore `in time`.
You therefore are looking at taking it to a county court setting and trying to prove that you have suffered metal anguish etc which is very hard to prove.

I guess rm managers will have stalled and tried to delay all this for as long as possible. have you tried simpson miller?

6 months ago whilst the b+h investigation was continuing

rang simpson and miller and they said i need to talk to the cwu area rep. Ive already left a voicemail on his mobile and office last week and got no response.

This is simply not good enough..
Bullying is not acceptable and should be dealt with immediately
Stay strong, ring the area rep again tomorrow,
Keep trying until you get to speak.
Failing that if i were you i would get straight onto Cwu Headquaters.
Maybe then someone will take some action on your behalf.

Hello,

From my own experience:

I think you need to get a LS3 form from your CWU rep.

This will allow you to claim damages for the stress you were put through. It's a claim for an injury at work. If liability has been admitted, you'll be in a good position.

The three month time limit does not apply - it's three years for this kind of claim.
