CWU rep accepts a management role.......

Yup. An oldie but a goodie. Our rep has accepted a white collar role but is refusing to resign.

Not forgetting his lack of motivation on being removed from duties to join the planners on our recent revision (probably a couple of days before it went live) my question is simple- how do we get rid?

Do we lodge a vote of no confidence amongst the office members? Do we forward and second our preferred candidate? Do we contact branch and have him kicked out?

If it is the former is a simple majority enough to have him emptied or would it be 50% + 1?

The two roles are incompatible with each other, also the management role is covered by the CMA. that should be a basis for getting rid. I would look into past precedence, I have had a couple of Reps who crossed over in my office they resigned their Rep position as they are no longer OPG grade which the CWU is charged to represent.

Hi Speckled, have posted this before on another thread, this extract is from MY Branch's rule book, suggest you contact your Branch for further clarity

1.3 Any representative of the Branch who decides to place himself/herself on the Acting Managers list or take up the position of an acting or substantive manager shall be deemed to have resigned from their CWU representative position within Branch and shall not be permitted to hold or stand for any future CWU position within the Branch. He/She may appeal against this decision to the Branch Committee who will make the final decision, however this will not preclude the individual(s) appealing to CWU Headquarters.

I knew i'd seen exactly that on another thread but Couldn't find it. Thanks for taking the time to repost it for me.
