Unpaid overtime????

Post by monkeymutha »

In our office we have been told that if we finish an hour early one day (such as a Monday), then if we overrun on a busy Wednesday and extend by an hour they won't pay us the hours overtime. Can they get away with this?

they keep doing this to us, they say if we do claim then they will bring in longs and shorts and those on 4 day weeks will have to go back to 5 days, local rep just says they will do it if we claim

So what would happen if I finished early on a Monday then come Wednesday refuse to extend for whatever reason? Would they dock an hours wages? The walk I'm on most days I finish early/on time (i.e. work fast) but some days it is mental and impossible to finish on time. Normally I would just extend and claim.

banking hours again routine

no they cannot bank hours
they tried this with me,
when i got my wage slip and it was not in their, and royal mail (manager) refused to pay i sent the DSM a 14 day letter before action for an ET claim

i got my payment within 2 days and nobody even speaks of banking hours anymore

sometimes you just have to dig in and say NO

section 13 employment rights act
unlawful deduction of wages

we did that up till a year ago(equated hours) then senior management said this was not the practice to be used so now even if 5 mins over in goes the docket

Keep claiming and get rid of rep.

There is no agreement on banking hours.
This is not part of any "flexibility" agreement.
It is up to management to fill your contracted hours with work on a daily basis,no-one should have any argument with that but if they cannot members should not be expected to work longer the following day to cover management/business failings.
Offices can agree long & shorts to try to better align workload to hours but again those hours should be fixed and no carry over of hours should occur.

Can any one put me straight, I am on a 22.5 hour contract, it is supposed to be 5 x 4.5 hours but from day one I was put on 4 x 5h 38m. This was not a problem, however my rounds paper work shows (for a 30hour/5 day week) that if I complete on time the best I can hope for is a 23.5hour week if I work the shortest shifts or 24hour 40mins if I have the longest 4 days of the week. Which means at best I should get 1 hour overtime per week and over 2.5 hours another time. (The thing is I don't want to work overtime, I just want to do 4.5 hours a day for 5 days or 5h 38m for 4 day and go home). Now today was a bad day and I went to put in for 1 hour 10 overtime which includes lapsing (which we seem to be doing every day since Jan. only to be told no overtime as we have not hit target for number of letters! My main problem is I am still in my 6 month probation period. What can I do, the union rep is as good as useless and has never even introduced himself since I have been there.

The Law is the law, Overtime payments are not a bonus for hitting targets they are for paying you for the hours you have worked for the business.
if he/she is refusing to pay, refuse to work the extra and use the cutting off procedure.
hunt down your rep and have a word - he may surprise you (or not but you never know until you ask)
