Ill Health retirement appeal

Hi,

This is my first post here though I have been a member for many months and worked for the Royal Mail Group for over 20 years.

Further to being 'lump summed' ill health retired out of the business last year I am in the process of appealing this decision for tier 2 with immediate pension.

The appeal process and subsequent medical are taking an age as I am unable to travel to the designated place due to my health issues.

I have requested somewhere nearer to home and have insisted that the medical be conducted with someone who suitably specialises in my chronic health problems.

Royal Mail have been dragging their feet with my requests and are still insisting that I should be able to attend their prefered venue and have offered to arrange a taxi but transport is not the issue for me.

All of my health issues are covered under the DDA. Degenerative disc disease, arthritis, CFS, diabetes and sciatica are just a few of my chronic health issues.

This is probably a daft question but:

If I win the appeal and I am awarded immediate pension, am I likely to be awarded back dated pay from the date that I was dumped.

I am assuming that if I do win the appeal that my dismissal was unlawfull, am I right in that assumption or am I being just daft.

Of course I am aware that if I do win the appeal I will be forced to return the lump sum, which by the way is preventing me from being able to claim any income related benefits.

Talk about a catch 22, I have informed DWP that I can't touch the lump sum because of the appeal and although they have been quite understanding I am still left to manage on ESA and DLA alone.

Don't ask about union rep and their input.

Rep hardly responded to any of my emails because of personal issues that they were having at the time.

I was told just before going into the meeting with the area manager that 'Royal mail wouldn't be able to offer me any other type of work that I might have been able to do' and 'that it was best that I go for ill health retirement'.

Rep also took the minutes of said meeting when I was dismissed because the manager present had never done the procedure befor.

You should write to HQ and lay out the problems. TBH I'm not sure if you opted for IHR or it was foisted on you and you were unaware that you would not automatically get your pension. Is your appeal over the original IHR decision?

I have all the emails between myself, union rep and regional Manager who is handling my appeal.

I had no idea that I had been dismissed untill the money was credited to my bank account.

I contacted HR as I assumed a mistake hade been made also emailed my union rep as I was in shock that I had not been notified in writing that this would be happening.

I was told during the meeting that I could only appeal after I had been paid off and that I should put the lump sum in a high interest account to make it work for me.

At the meeting that I attended I had no idea that it was to terminate my employment from that day.

I was forced to phone my local CWU office to ask for advice and was told that my union rep had gone about it all wrong.

After being advised to contact HQ I refused to be represented by my union rep.

Looks like the union and management work hand in hand.

I plan to act on this information in section 4 of the agreement.

Looks like I was well and truly foisted.

if you win you're appeal then you were wrongly dismissed and should be awarded back pay from when you were finished. hopefully this will make up for the money used from you're lump sum.

Thanks for your input Davey, I did wonder if that would be the case thaks for clarifying that.

Both union and management have gone very quiet and have not replied to emails yet.

You've been IHRd and you are appealing the decision.
I think that puts you in a very small category of people.
I'm not sure you can hope to remain anonymous. (if anyone really cared)
