Its part of the flexibility agreement and applies only in certain circumstances not just at the whim of the manager.

• Variation of hours – Where necessary, for example when traffic
volumes are unexpectedly high or resourcing issues arise, individuals
may be asked and may themselves request to vary their duty times by
up to 30 minutes on a swings and roundabouts basis. Again, individual
circumstances will be taken into account and total weekly contractual
hours would not change.

I get this regularly. I've had enough of this. I tell my "manager" I need to finish on my time and he claims 30 min flexibility! WTF! How is me working an extra 30 min.going to get me finished on my time? Someone is going to get seriously hurt.

Good question. I asked about this in a recent WTLL session, where our Area Rep was in attendance. I pointed out that the proposed revision would incur problems around not having time to complete workloads with duty times/structures being proposed. The boss sais that, in these instances, we would be asked to flex, so I said that flexibility A) doesn't apply (as it wouldn't be an unusual/exceptional mail volumes or resourcing problems - but the norm they haven't properly planned for), and B) it is not enforceable, i.e. we can refuse if we choose. To which the Area Rep - not the boss - said we couldn't, he said if we were asked to flex we had to do it, as it was in 2007 Pay & Mod agreement. Told him he was wrong, and that I wouldn't be doing it.

I'm certain most Reps wouldn't have said, nor share this interpretation, but when ours said it what chance have we got?

to be honest weve had this for 2+ yrs now in our office with p&l , its another way of calling it banking hours, all they ever say is we just want you to work your hours your paid for which is fair enough be he wont let you put any docket down till a Saturday , but when you get the runners the early starters getting back at 12.15 and your out till 2.30 as your duty is 5 hrs + , but there not working the 39 hrs per week . so flexibility doesn't count for these people.

As far as im aware they can ask you to flex ....but its indoor flex NOT outdoor and it has to be given back before the end of the week it is not to be used to work over in delivery !!!!! These managers will say anything to get the mail out plus its 30 mins once a week not every day

I hope you're not suggesting a manager would lie to get a staff member to do what he wants? That they would deliberately, and knowingly, twist agreements to their advantage, hoping all the while that the staff member in question is unaware of the particular agreement and it's wording?

There is no limit on where the flex is it can be indoor or outdoor.

Correct. We have had the same issue in our office. Thanks to the runners in our office we will soon be asked to lapse as well.
