Dismissed for going sick

They finally did it,

Got notice of dismissal today,even though I am covered on the equalities act for depression, looks like the union were right that RM would take a punt, to see if I would appeal, and to see if the Union would react.

Knowing I could be out of a job in 4 weeks time is not doing my head any good, no-one at home, feel really s**t on, don't know how I'm going to tell the missus when she gets home, anyone else been like this, and got through it ?

Well the Union have told me to appeal naturally, so thats what I'm doing, our rep reckons that RM are taking the odd gamble to see if they can get away with getting rid of a load of DDA's on the books.
I may have had my name pulled out of the hat, only problem with that is that the periods of depression can be linked backed to RM !!

unfortunately just because your illness is covered under equalities act it doesnt completely protect you from the attendance procedure and dismissal, Royal mail have to make a "reasonable adjustment" to accommodate you, so saying that your going to probably need a little extra time off sick per year would be a reasonable adjustment but if that time off was deemed excessive (several months or more for example) then they would be entitled to follow normal procedures as they allowed you what would be seen as a reasonable adjustment and you exceeded it,

out of interest how much were you off in total in the last 12 months?

if your illness has been on going for 12 months or more you are covered by the DDA its a thorn in the side of RM.Appeal straight away and get the union to put in a ET1.You could also put ij a grievance.The more paperwork the better.I was covered by DDA but as they new they would loose the dom and his colluding line manager and the then Cluster manager (covieniant witness / interviewer/ and yes decision maker ) in my dismissal just shows you what lengths these low life scumbags will go to.If you knew or found out some time later that these same clowns were all moved you would like myself become rather curious as to why they were moved.Maybe RM had to move them as if it got out how they really got rid of me could have serious Criminal implications .All i can say is a advisor at CAB has told me to get the Boys in Blue to investigate.

The last period was 84 days, this was due to me having severe suicidal thoughts, it took a few weeks of counseling and work for them to realise I had been on the wrong drugs for about 18 months, which affected my behaviour patterns, they weaned me off that onto another drug, that has stabilised my mood pattern to a near normal, this all took time, and I wasn't allowed back to work, until the mental health team were confident I was fit to return.
As a note, I know every case is defferent, but I know another postie, who has had 9 stage 3's due to absence with depression, yet he has never had the threat of dismissalhe was off for a total of 29 weeks last year.

in your appeal your rep should look at how royal mail failed to follow procedure.For example - your rep should go back through all of the stages and see if any of them should have been issued and get them revoked so you are not on a stage 3. Remember an employment tribunal needs to be put in within 90 days of your decision letter to dismiss you.
Do not rely on an appeal to get your job back.Were you warned in a letter that your absences for depression were no longer being discounted at any stage before you were sacked.Were atos involved at all stages whilst you were off sick.Did your manager do everything he should have done to support you .These are examples were a good rep will pluck out and use in your appeal.When you go to an et ,the judge will look at how rm didnt follow procedure and not that you were just fired.

i think you will find that an employment judge is the only person who will judge what is a reasonable amount of time,not you not royal fail and certainly not some spotty yoof in HR services.

Your sort of right but before it gets that far, someone at Royal Mail has to decide what would be a reasonable adjustment, and the employee agree to it and then follow the normal procedures if appropriate if it is exceeded, then after dismissal if it occurs then and only then would a judge look at it, a judge doesn't look at every single case that arises to seem what is reasonable they only look at it if the case comes before them

if the other persons record is used as a measurer and that record was worse then that wouldnt look good in the et

think rm might be playing a percentage game here hoping that you dont appeal.

sounds all to common .Such a caring company.No offer o IHF they must have paid out to much on last years IHR budget .I fear another wave of dodgy dismissals in the final push to Privatisation watch your backs and trust no one folks.
