holiday pay after leaving

i left my post last week on thursday 28th of febuary handing in my letter of resignation and my last day then being tuesday 4th march prior to this i had been suspended from duty for 2 weeks when i left i had 12 days annual leave left can they then count this as part of your suspention or should they still pay me my annual leave the reason i ask is because had payslip today and says leaver overpayments minus £49.69

If you are suspended you are not on annual leave.
Any outstanding accrued annual leave should be paid.
Contact HR to find out what the overpayments relate to and when you will be paid your annual leave.

contacted hr they said my boss has put in that my last day of work was on the 28th of febuary not the 5th of march i handed in my notice on the 28th and has not told them about any holiday pay owing

Did you put a date in your letter for the last day of employment - or perhaps dated the letter itself and mentioned 1 weeks notice. If so and you have a copy then contact the Union and see if they can get it changed.

If no dates were mentioned then its probably going to come down to your word against their word.

Have to say though the few times that someone who is on suspension and resigns in my office, it always seems to be immediately effective.
