Criminal convictions

Post by Fairweatherpostman »

Hi just a question which I would like to ask... I was arrested and awaiting trial at court.if I get convicted I'm not sure what's going to happen to me when I tell my manager? I have read on the website that Royal Mail woul not accept me if I applied for a job with them an had a conviction but can't find any information about this situation? Also I would like to know how often Royal Mail conduct a crb check on me? I will be telling my manager because it states that I must in my contract but would just like to know where I stand with this matter. Thanks to anyone that answers and who helps

What I meant by what will happen when I tell my manager is basically will I get dismissed.

working for royal mail is a notifiable occupation, the police will/may actually inform royal mail themselves about the matter

Do you think they would be likely to dismiss me? The police don't know that I am working for Royal Mail unless someone tells them but I wouldn't think they would

I guess the real answer I want to know is will I be dismissed for having a conviction? Has anyone else incountered the same problem? I will be honest with my manager and tell him if I get convicted as I believe it's better to be honest and find out from me rather than someone else.

The following offences if ‘unspent’ are considered unacceptable in new recruits to Royal Mail.
Please note: The list below is not exhaustive but instead is designed to give an indication of the type of offences that Royal Mail normally considers unacceptable.

Theft and all offences of dishonest appropriation (including going equipped to burgle, taking a vehicle without consent, handling stolen property, making-off without paying)
Fraud, forgery or counterfeiting offences (including benefit deception, traveling on public transport without paying)
Firearms and weapons offences (including possessing a sharp object in public, possession of a noxious gas)
Terrorism (other than certain conflict-related offences subject to the Northern Ireland Good Friday Agreement - these do not need to be declared during application and will be considered by applying the employers’ guidance issued by the Office of the First Minister & Deputy First Minister, Northern Ireland)
Offences under the Postal Services Act 2000 and prior legislation
Arson
Supply or intent to supply any category of drugs or possession of category A drugs
Offences against the Justice System (including perjury, bribery, making false statements, contempt of court)
Offences against the person (including assault, causing grievous or actual bodily harm, battery, affray, racial or verbal harassment, making threats)
Sexual offences
Breaches of orders

I would imagine the list for existing employees is pretty similar although sacking someone and deciding not to employ someone are two different things.
Every case should be taken on it's own merits as well as any mitigating circumstances.
Honesty is definitely the best policy,if they find out second hand it will harm your case.
Nothing is written in stone.
Take advice from your union rep first, preferably at Area level or above.

Unfair procedure used to dismiss convicted employee

Wilson v Royal Mail Group Ltd ET/2329775/2010
28 January 2011

http://www.xperthr.co.uk/article/107098 ... loyee.aspx" onclick="window.open(this.href);return false;

Royal Mail's code of conduct deals with criminal conduct committed outside the workplace. It says that criminal actions should not be treated as an automatic reason for disciplinary action or dismissal unless the offence is relevant to the convicted employee's duties. The code makes clear that the key considerations are whether or not the conviction makes him or her an unsuitable colleague in the eyes of other employees or brings the business into disrepute. The code also requires employees to inform their manager if they are charged with, or summonsed to appear in court in relation to, a criminal offence (with the exception of minor road traffic violations).

The appeal panel accepted that Mr Comben should have waited until she had returned to work and there was no basis for concluding that Ms Wilson's conviction damaged the employer's reputation. However, the panel rejected Ms Wilson's appeal against dismissal because of her failure to inform the employer of the charges and subsequent dishonesty.

I agree that it would depend what you have done assuming you are convicted, also assuming that Royal Mail is a notifiable employer, and you fall into category 2 then the police would decide , as I understand it, whether your employer is notified. If it a minor offence they probably would not such as a driving offence unless it caused you to lose your licence for example.
If it is a minor offence that would not be notified you would have to decide whether to risk not informing your manager .I would suspect that there would be a chance of your name being in your local newspaper in their round-up of magistrates courts in your area.
Your best bet I think would be to speak in confidence to your area rep or higher as FT recommends.

My own experience is that I've shared matters of a confidential nature behind the DiM's closed office door and within the next 5 minutes 'endured' snide knowing comments about that private matter - to the extent that I checked that my mobile hadn't mistakenly been left on when I was in his office!!.
I trust that if you're dependent on your RM income your circumstances wont be compromised by what's happening in your personal life; you've done the right thing by coming to the well-of-knowledge that is RMC.. Good Luck.

Going on what has happened before in our office , you'd be out the door if it's theft or fraud but ok if you've kicked the crap out of someone as long as it wasn't a work colleague. But tell the DIM before he/she reads it in the local rag over his/her morning cuppa. If you get some time I'm not sure what will happen but least with the later start times a tag and curfew won't be a problem.
