Equality act/stage warning

Hi folks, been off with a condition which I have now found out off the Atos doctor is covered by the equality act. I also found out from him that I am covered under the same act due to another condition which does not relate to this absence. Does anybody know if I will be put on a stage one warning when I return to work,or will the act cover me in this situation so I won't be staged. Many thanks guys

just because you have an illness/injury/disability covered by the equality act doesnt automatically mean you wont get a stage warning, you can still get stage warnings and even dismissed under the attendance procedure, what has to happen though is RM have to take reasonable steps to accommodate your condition, now if having a couple of days sick every couple of months etc then not going down the attendance procedure would probably be seen as reasonable, but if you were constantly being ill for 11 out of the 12 months of the year then the attendance procedure would (proabably) be appropriate (IHR probably more so but you should get what i mean)

One lad in our DO got staged (1) for an illness covered under the equality act.

He had 16 days off in one year.

Only five of those days (in one block) was due to his condition. It was the illness that triggered the stage.

That's not reasonable.

You will get stage 1 as they are issued automatically for the amount of days your off. Unfortunately you can't appeal on a stage one 1. I did have stage one reversed once as I had an accident on duty,which triggered the stage 1.

You only trigger a stage review. They are not automatic.

However, when a typical, spineless line manger gets involved, all that goes out of the window and the stage one review gets rubber stamped and then a stage is issued.

I think I have that just about right.

iv had stage 1 after A.O.D. even though royal mail addmitted liability and paid compo my line manager decided i was off to long even though doctor/phisio/and atos said i was unfit for work .
