Equality/DDA Act and harassment by DOM

Covered under the equality act for having depression, and fatigue and plantar fasciitis, transferred from another office 5 months ago after 10 years at another one, signed for a duty on senority that was a rest day cover come off for medical reasons and people who van shared with took advantage and gave me the hard bits of the loops, spoke to the dom and union rep both agreed i was taken advantage of but did nothing to sort it so i signed for a vacant single van duty that came up, was told i could by the dom whilst waiting for atos report, he then told someone less senior to me that he had got it, wasnt happy with that so went to area and branch reps who said the duty was mine and was covered under the equality act, dom then said he wouldnt let me have the duty becoz he told someone else they had it, still waiting to hear from the area and branch reps, not happy with this at all, lot more to add, want to know if any one else has had similar problems and what they did?

DDA does not give anyone the right to a specific duty. It only means that they have to identify duties that you are capable of doing and in a re-sign you would get one of them. Or they are required to make reasonable adjustments to the duty you are already on.

Almost right,the identifying of a duty should be done by all three parties,manager,rep and the individual concerned.
Once a duty has been identified and any necessary adjustments made it should be ringfenced.

well after being told i can, union rep helped other people before inc. his wife, the people who took advantage of me effectifly forcing me off current duty havent been spoken to so its ok to mistreat me rather than do their job

spoke to the area rep tonight he reckons i will get the next duty available, apparantly thats what the dom has told them, ill try and get that in writing. fingers crossed, dont trust the dom either

thanks mate yeah i had pneumonia last year so thats y im trying not to let them mistreat me, well see i may have to go higher up the chain

does anyone know how to get hold of a copy of the way forward agreement and how to find out who your doms boss is and to contact them?

you might want to contact your branch equality rep too, specifically trained in these matters, also check if your branch has a disability champion too.

Update on situ, Dom refused me the duty becoz my atos report was received a day after the closing day of the vacancy, he basically used a technicality to deny me.

id check those dates
also find out if the union rep knew if the duty had been given out on that date
