Assault at Work
Hi
I was assaulted at work by a colleague. This he admitted to the manager.
I am off work due to stress/assault and am waiting for the investigation to be completed.
I am close to using all my 6 month sickness allowance, will I still lose the full amount sick pay?

I believe it will go down to half pay after six months, depending on during which periods you have used up the six months at full pay. Someone should be able to download the sickness agreement for you to look at.

I think if the absence is due to an accident at work or in this case an assault you should still get full pay, not 100% certain on that though. I think someone on here should be able to say for definate . I think you should get the Police involved as I don't think RM Managers are up to the task of dealing with things like this

I was hoping that yes if its an assault accident at work you should get paid.
As to getting the police involved, it wasnt a serious assault, hopefully i would expect him to be moved to a different office. I want to stay off work until this is resolved and him moved.
Can anyone else confirm the post by P13. That I should recieve sick pay even after the six month period.
Could I claim damages for the stress, there was no real physical injury, the person who assaulted me has previously assaulted a customer in the same office as well as an unresolved assault claim on a manager?
Im going to lose around five hundred quid in christmas tips because of this, could i claim for this

Unless you paid tax on previous tips I would think unlikely as you would have no proof . Also as you haven't involved police it becomes a civil matter. If you haven't taken it to court then Royal Mail cannot force him to pay compensation as there has been no proven incident of a crime for which a qualified person has passed a ruling on.
At the moment you have made an allegation and he has admitted to an incident. All Royal Mail have to do is deal with it reasonably.
Oh and you need to contact your Area Rep and advise them of the situation as they will be able to advise, knowing the full history of the case, whether or not you would be entitled to full pay after 6 months.

Blackmora, have you used up all the six month period due to said incident, or is this a recent event but you have been off work for another reason previously?

Are you a member of the union blackmora? Is the person who assaulted you? Has he been suspended? Have you any witnesses? What if they don't move him and move you instead?

How has he not been sacked already?
