Manager caught at customs

Greetings.

A manager at our place has been caught at customs at Dover with a car full of duty free cigarettes.

The cigarettes have been confiscated and he has lost his money, he was planning on selling the cigarettes and making a profit.
I wonder how the business would view this, would this fall under the category of "bringing the business into disrepute?"

Opinions and advice on this subject would be most welcome as this manager has been responsible for previous sackings of very good Postmen.
Postmen who had very good work ethics.

Was he selling them at work?

I remember someone who got sacked for that when IB investigated them for something else.

He is collecting money from people at work and then driving to France and buying duty free.

He collected everyone's money and then got stopped at customs and all the cigarettes were confiscated.

he has had to give everyone's money back at work.

Quite a few people are involved.

No point in reporting it - working for Royal Mail is a notifiable occupation ergo - if HMRC are doing the job correctly, and the "crime" was sufficient enough to report it to Royal Mail they will do so.

Having seen what the low-life lying scum will go to to get rid of a postie, I would want to ensure his behaviour was highlighted to Moya, just in case all this "notifiable" business didn't lead anywhere.
If nothing else it marks his card for future misdemeanours.

But if customs at Dover caught him with a car full of duty free cigarettes which have been confiscated then surely he failed to declare them which I would have thought was breaking the law. 'Caught' suggests he intended not declaring them and surely even a DOM wouldn't try to claim that a 'car full of duty free cigarettes' was for his own personal use.
Shame he hadn't gone over in a Royal Mail van or artic as that would surely have got him the sack.

he should have just said they were for HIS own personal use and he wasnt selling any theirs no limit only if over 3200 you get asked questions DIM

There is no legal limit to the number of cigarettes you can bring through customs with the caveat that they must be for personal use.
HMRC have the right to make the decision on what is for personal use and seize anything above that judgement but it isn't illegal to bring too many back basically because it would be impossible to enforce.
They also have the right to seize your vehicle so he should consider himself lucky.

It's only 800 now not 3,200.
It changed in October 2011.
