Hi there,

I went for an interview on Monday to be a postie, The interview went well I think :nervous

I have never been convicted but I did receive a Caution for Producing Cannabis about 3 years ago. If I recall, Cautions are spent immediatly and don't have to be disclosed.

Do RM do a basic CRB check ( Which as far as I know, Doesn't show cautions, only convictions..(?) ) Or do they perform an Enhanced crb check? To which I think the caution would show?

If the caution does show, Do you think I would be ruled out for the position? :arrrghhh

I have a caution on my record that I got about 5 years before my RM CRB check. I would think they use an enhanced CRB check due to us handling special deliveries etc etc.

it did'nt stop me getting the job, however it was for something a bit more trivial than your's is.

all you can do is wait and see really. unless someone on here knows different.

You should read what Royal Mail say in the online application , im sure it says declare all cautions and convictions....

I wouldn't bother saying anything,I've got a pretty checkered history with 2 sentences served,both less than 6 months and I've been here for over 5 but less than 15 years.

All postal operators in the UK have to comply with the Mail Integrity Code to keep their licence:

"a requirement for prospective Relevant Employees to declare any criminal convictions or any cautions or conditional discharges for offences relating to:
(i) Postal Packets; or
(ii) dishonest conduct generally (in particular, theft, obtaining property by deception or fraud)
and guidelines on how any such convictions, cautions or conditional discharges declared by prospective Relevant Employees will be taken into consideration in deciding whether or not to employ the prospective Relevant Employee."

This requirement forces postal operators to ask employees to disclose information that they don't have to disclose (Rehabilitation of Offenders Act 1974). Providing a postal service is not something that is exempt from the ROA so postal operators may only ask for information that is revealed by a basic disclosure. However, technically it is not against the law for postal operators to ask people to reveal information they don't have to reveal even though this makes postal operators appear deceitful.

Anyone with a spent criminal conviction who wants to infiltrate a postal company to do crime would be aware that postal operators can only ask you to do a Basic Disclosure and the infiltrator would know they don't have to reveal their spent convictions regardless of the wording on the form. The questions will not catch out someone with criminal intent, they will only make it less likely that people with spent convictions find it harder to be rehabilitated and get treated the same as everyone else in society.

There is no reason why your employer should know you are a retired cannabis farmer because your conviction is spent.

"Cautions (including reprimands and warnings) are covered by the Rehabilitation of Offenders Act 1974 so will become spent immediately (apart from conditional cautions which will become spent after 3 months). This means that if you are asked on an application form if you have a caution you can reply 'no'. For conditional cautions it would be after 3 months since the caution was issued, up until that time you would have to reply 'yes'."

Thanks very much for the info guys!

I received an email last week saying congrats I have passed the assessment, we are moving your application to the next stage. We will contact you again in the next few days to discuss your application further.

When I log in to the jobsite it gives me info as if I have a job offer woop woop :Very Happy

I hope this silly caution for growing a couple of plants doesn't stop this comign through :d'oh!

I wouldn't of called myself a farmer buddy lol, I had 2 plants in my greenhouse with my tomatoes and runner beans :)

Received another email from RM stating I have been conditionally offered the position :Very Happy

The email asks 4-5 questions, Asking me to reply. One the Q's it asks ''Do you have any UNSPENT criminal convictions, cautions, impending prosecutions or conditional discharges, which have not previously been declared to us? If yes, please give details.'' To which I answered No, This is correct?

Someone please tell me the crb checks are gonne be fine!! :nervous :nervous :thumbup

Should be, stop flapping there will be plenty of time for that later,usually around the 2 or 3 year mark good luck with your new job.

It will be mate,you will laugh about this in a few years.I got pulled by the old Bill early one morning on my way to work as a factory nearby had been set on fire in an arson attack and the police did a quick check on me and the only thing that came up was a conviction for ABH,despite the fact that I was on remand in Lincoln prison for 6 weeks in the 80's and received a 4 month sentence in the late 70's,people worry to much about these things,it might be different if any were for stealing but all I was guilty off was normal growing up things,nothing serious,lads will be lads eh.

Hi
I went for a crimbo postie job and got through the interview then given a date to start (16th nov 2012)
I have convictions 6 i think all spent over 10 years ago (10 years being the newest!)
On the 12 nov i get a letter telling me to phone "Disclosure scotland" which i did and they wanted to verifi i was who i was etc
Then on the 14th nov i get an email saying "we are sory but upon reviewing your disclosure you do not seem to be the kind of employe that we would like to have working for us"!!!!!
if you would like a copie of the disclosure please write to (yadayada,etc)
So i did and after 7.2 weeks i get the original disclosure form (with all third party info deleated -well marker penned out)
It says its a basic disclosure HOWEVER every thing i had done wrong since 1998 was on there every single spent conviction (1998 being 15 years ago)
now my querry is if you dont have to tell your almost employer any of your spent criminal activity (unless you wanna work with kids , old , disabled , ect)
how come Rm had accsess to my basic dislosure (which should only say "NOT AT THIS LEVL OF DISCLOSURE" all the way through it)and also had accsess to all my spent convictions to read my lfe book like it was a sunday W&*k mag!!!!

Royal Mail is exempt from the Rehabilitations of Offenders Act 1974 , therefore spent and unspent convictions are visible to Royal Mail. Given what you have said I agree with the Royal Mail reply in that I wouldn't offer you a job at the Post Office

This is complete bollocks. Royal Mail is not exempt from the Rehabilitations of Offenders Act 1974 much as you would wish it be.
