Delay to ill Heath retirement with lumpsum payment

Hi,I was given 10 weeks notice of dismissal in October 2011 after being off sick with depression since march 2011, I was dismissed in January 2012,finally got an appeal in march after no contact from Royal Mail and the cwu union couldn't get anywhere I had to contact Acas .The outcome of the appeal was ill Heath retirement with lump sum in a letter in may and will be referred back to my office manager to process IHR with lump sum, after numerous attempt to actually get this process dealt with including the union failing to get responses I am still (nearly 7 months on from decision)without payment and struggling living on £71.00 per week on benefits with a mental health disability.

So my main question is , do they have to reinstate me to retire me and does that mean they will have to backdate pay back to January ?

no they dont need to give you the backpay but you would be entitled to get interest for the time of the delay in paying out

Dunno what rms policy is but a tribunal would be 8% i think

when deciding interest equation in any litigation, the Office of Fair Trading has set the interest rate to be claimed at 8 %
