Question about sickness

HI i was wodering if some one could give me some advice.

I have been of sick for 3 months and do not look likely to be back for at least another couple of months.

Anyways i recieved a letter today saying i have to attend a stage 1 interview with my manager.

i have spoke to Atos a few times and they have said in there reports that "disregarding the effect of treatment mr ******* would be considered as disabled under the Equality Act".

My question is are they allowed to do this?

It isn't common to invite you to the interview while you are still off sick.
The length of your absence will have triggered a Stage 1 interview.
That doesn't mean the stage 1 will be issued.

You go to the interview with your rep.
You explain your absence is due to a condition recognised by ATOS as a disability under the Equality Act.
You quote the Attendance Procedure that states that absences due to a disability should be discounted from the procedure, unless you have been told before that it won't.

And if they issue a stage 1 warning anyway, put in a grievance.

Looking at mt attendence procedure form they sent with the paperwork i think i triggered a stage one before i was off sick again. it seems they just didnt do the interview before i went off this time.

is there any time limit they have to issue a stage one?

a stage 1 is issued when you return to work through sickness not when your still off , ring and tell them that you are unable to attend and all this is making the situation worse through stress , go to your doctors and explain to him/she that you feel really stressed over this and its not helping , then next time atos ring tell them the same , as long as you keep getting sick notes no probs , hope everthing works out for yer.

i think i have messed this whole situtian up, i have already sent the reply slip back saying i will attend meeting without represention.

How would HR issue the he's hit a stage letter?
Is this off the screws own back?

Phone the office up,tell them you've made a mistake and you want the rep there.

Cheers mate i think i will do that tomorrow. i am off with mental health issues, ie personality disorder and am on strong drugs and im not really thinking straight one minute from the next. i sent the form off today thinking i will take the stage and then see what happens next. if the went for a stage 2 then i would get union rep involved but obviously i should have him there with me . is that right?
