Can someone please help,I have been suspended 3weeks now but when I was originally suspended I was not asked wether I require a witness or union rep present,to be honest I didn't even know I was about to be suspended!the suspension was over ot I had booked.my union rep is saying they have gone away from ir framework and what they did was wrong.could anyone advise.thanks.

Are acas involved at the appeal stage, I thought there would be just one appeal manager and a note taker.

i am not sure if you work in a dely or at a mail centre.If you have local rep in your workplace then you would have had the right to ask for him to be present as it was a matter of conduct.Even if you had a friend to go in there with you.You have not made it clear whether you did ask at the time of the suspension for a witness.I would say that management have broken procedure with this and you could argue this at fact finding.You have a right to be accompanied at any conduct meeting.You also have had no communication around your suspension in terms of the 48 hrs or indeed the 3 weeks that you have been off ,unless this is the case.Again royal mail have broken procedure in terms of the conduct code.
I am not clear on whether you have been called to interview yet or not? Presumibly it is about gross misconduct over the overtime and claiming?

You will receive the fact finding interview to gather evidence and then go onto the conduct interview.Unfortunatley it depends on what you get as to where you go from there?

Thanks for your replies.when I was being told I was being suspended I was never offered the chance for a witness.since then I've had my meetings and now waiting decision,the manager is claiming he did offer me a witness which he didn't so I suppose it's my word against his!the crux of the case is I am a phg and was sent out on full walks after making sure my own work was done,they are claiming the ot was not authorised yet its common practice in office to tell phg inputting what you have done,amazingly the phg is now claiming he never imputed my ot and making out I did my own!im in a mess and just hoping I dnt get sacked,my rep says at worst I will be back as postie as I can prove I did work.any help is welcome as I'm going mad here!

Surely a manager told you to go out on this walk and he would have authorised it. If you did the overtime how can you be suspended.

I have given up at trying to work out the logic of how RM works. This is just my opinion. Hope all goes well for you.

Why would you have access to the input program?

Because in our office the phg inputs the ot and one day a week I'm on that duty and no one has ever told me not to!as for manager authorising they just always said go out and we would book it with phg on dduty,we dnt have a real structure at ours as I'm sure alot of you dnt!any help is greatly appreciated thanks,my rep says I shouldn't get sacked but you still worry!

ACAS are not involved at the appeal stage, and will never never be.


The only note taker will be you or your independent witness.

I just despair about some delivery offices and DOMs refusing to use OT sheets or dockets. We don't have signed dockets in our place too. I have queried this over and over but the DOMs just does not want it. I have worked in MC and MDEC where the dockets are OKed and signed - transparent!

We used to have a DOM that says OK to your OT (going over OT or even extras OT; he even writes it on scrap pieces of paper) but then he does not pay you - hoping that you will forget and/or tries to cut down on a particular weeks OT figures.

This particular manager virtually took the job away from the PHG and can be seen doing the OT input himself or supervising it.

Now the PHG does the inputs and often (these days) they go out delivering, But I am sort of curious how you can pack a full delivery in addition to your normal duty as a PHG?

I think your system needs overhauling, making more transparent and fire-walled and protected both against fraud and/or against the accusation or insinuation of fraud.

I managed to go out as it just leaves us short indoors altho foolishly I do rush about before I go out to make sure my work is done,but now the managers are just acting like they cnt believe I would book ot and trying to make me out to be deceitful!just hope I keep my job,not even bothered if I go back as a postie as right now I'm just scared.
