Ill Health Query

I know there is a lot of topics on Ill Health Retirement and believe me i have read most of them trying to find out information. What i am unsure of is this question: Can RM decide to retire you if Atos recomend that it shouldnt be an option at the moment? Basically Dom wants rid of me but i am not sure if i want to leave and Atos dont see it as an option at present anyway.

Any help would be most grateful.

I left under IHR last friday (28th Sept) but when I first had my symptons confirmed by a specialist ATOS said that I wouldn't be considered for IHR because I would need to have the symptons for at least 12 months,but as time went on and my knee got gradually worse they changed their minds about a month ago after Royal Mail had offered me IHR.I will have had my problem 12 months come this november.

In my case and I hope in yours I get the impression that they won't be able to get rid of you just like that.

masada, if Atos have NOT recommended IHR how is it an issue? if you have reached Stage 3 due to time off in the Attendance Procedure, you may ask for IHR, if you have a protected charistic or a physical or mental issue lasting 12 months or more IHR comes your way,if this is the case you are covered by the Equality Act 2010 and reasonable adjustment to YOUR duty should take place and be offered
