accident at work

this morning in the heavy rain i tripped up a very small step [about 1 inch height just didn't see it in rain} anyway fell over and have hurt my left up i finished my delivery and
went back to office to do accident form well manager did on computer when he finished i said i wanted to read what he had wrote he smurked and said he had said i was partly to blame and if i go sick i will get a stage warning is this correct can do anything i hope i havent broken it im off to doctors later

There are two different things filled out. The ERICA is the electronic accident book, you provide the information for this, read it back and verify it as a correct account.

The Managers Accident Investigation Report, may be completed whilst you are present but its content is not for you and you are not entitled to see it. At the end of that report an assessment will be made as to the Root Cause(s) of the accident. You must be informed, at least verbally, of the Root Cause(s).

Just because you have an Lost Time Accident On Duty it does not mean that you are exempt from the Stage Procedure for sickness. Officially AOD's are not 'normally' counted, which means that to be counted an explanation must be provided to show why 'normal' rules were not applied. If the accident was deemed to be your fault then that would be given as the reason for counting the absence towards the Stage Procedure.

It would be your job together with the H&S Rep(s) and/or IR Rep to dispute a Root Cause where you have been implicated at the earliest opportunity.

That's not true.
It forms part of your employment record,is considered to be personal information about you and is subject to the Data Protection Act and a subject access request if necessary although the ICO would look very dimly on an employer who refused a simple request to see information relating to their personal employment details.

Withholding the Investigation report would also make it almost impossible for the member to adequately defend themselves over a blameworthy charge.
I've never had any problems obtaining the Accident Investigation Report on behalf of members,i'm surprised you have. :hmmmm

I have only been instructed to make available the Root Cause section for the Member/Union Rep, the entire document has only ever been available for the Manager performing the Stage Interview. So far I've not had any problems with this system. To be fair the only information input which does not come directly from the IP and/or their reconstruction is the 'How' section of '5W 1H' where the Manager inputs their description of how the task should have been performed along side of how it was being performed.

How does he know you would be on a stage 1 and did he also go out and investigate where the accident took place?

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

thanks doctor gave me sick note unfit for week for 1 week wants to see me tuesday, i am left handed and cant even get dresses without being in agony. anyway this morning before 8 i get 2 text messages to ring him. he says come to week tomorrow on light duties and he want put me down as sick. i told him the doctors note says unfit for work and i cant do anything , plus i might be off for more than 1 week. hes going to pester me later he has form for hassasment but is idiot who is unable to run office or keep
his temper but thats another story

Blaming' Accident Victims
The accident should be investigated and analysed as soon as possible. It's important to be open, honest and objective throughout the investigation process with no pre-conceived ideas about the process, the equipment or the people involved in an adverse event and importantly the investigation should be wary of blaming individuals. The investigations must find the causes, learn from past failures and prevent future failures - Not Blame People. Underlying causes and root causes need to all identified and remedied. The investigations should be conducted with accident prevention in mind, not
placing blame. Attempting to apportion blame is counterproductive, because people become defensive and uncooperative. If any individuals acted inappropriately then the aim should be to Inform, Instruct, Train and Supervise better. The HSE advise that Investigations that conclude that Worker or Operator error was the sole cause are rarely acceptable. Underpinning the ‘human error’ there will be a number of underlying causes that created the environment in which human errors were inevitable. For example inadequate training and supervision, poor equipment design, lack of management commitment, poor safety culture creating poor attitudes to health and safety. The objective is to establish not only how the adverse event happened,
but more importantly, what allowed it to happen. As the HSE again advise - The root causes of adverse events are almost inevitably management, organisational or planning failures.

With no previous sick record I just got a stage 1 because I had 20 days off work (12 working days) taking out w/ends & public hols, I was bitten by a dog at work through a fence outside a known hazard property, the dog warning card was not in place (I do not prep mail) I was on light duties immediately affter dog attack, limping for a week & half, went back on delivery and my other leg (knee)kept swelling up and I couldnt complete delivery. Doctor linked my knee problem directly to pressure of limping due to the dog bite & issued a note, I got a fit for modified duties note,
Went back to work & was refused light duties (was doing pkts & collections) even though they had to put the work I had been doing out to O/T, was told to complete a delivery or report sick, was told if I stayed at work without doing delivery I would be disciplined for( absent on duty) so reluctantly went sick, I have not received anything blaming me for the accident either.
According to my manager there are no mitigating circumstances not to issue it! So accident at work, doctors cert, no previous sick and still got a stage 1,
What a great employer!

Thats absolutely disgraceful, I would appeal that decision and contact the H&S rep or even the area H&S rep to raise this matter.

Apparently you cannot appeal against the managers decision so grievance procedure is the only way, I am getting one in on Monday.

Will contact my area safety rep too!

When I suffered an AOD (caused by faulty equipment), I was told that "accidents on duty are not normally discounted". :crazy: :crazy: Needless to say, I got a Stage warning! :crazy: :arrrghhh :crazy:
