Driving Allowance Grievance

Hi, about a 18 months ago I discovered that the van that I had been driving since 2008 qualified for the MGV driving allowance. Obviously I went to my DOM to see about getting the allowance and getting any backdated monies that I'm owed. Not surprisingly the boss tried to make out that I wasn't entitled to any driving allowance, but with a bit of persistence and some of the downloads from this site, eventually he had to concede that I was due the driving allowance.

Although the DOM promised to sort it out, he basically messed me about until April this year when I lost patience with him and filed a grievance. It went quiet until a couple of months ago when the unit rep came to me and told me that the DSM had offered a compromise. The DSM was willing to make a cash payment to settle the grievance, but the payment by my reckoning was only a fraction of what I would be actually owed, so I turned it down.

Went quiet again until this morning when the unit rep told me that the branch rep's had pushed on the grievance, and were willing to back me "100%", but that the DSM would look to recover the money from another member of staff in the unit, specifically from a person that's a close personal friend, and that the previous offer was still on the table. As I said to my unit rep, I feel this is just an attempt by the DSM to blackmail me into taking the cash offer and dropping the grievance. First thing I did was talk to my friend and let him know the situation, and give him his due he was OK about it, but as he's been receiving driving allowance since 2006, which would be pre MTSF, neither one of us can see how the DSM can try to "Claw Back" any money.

In a nutshell, the management in my office have made a complete mess of allocating the allowances, but there's little chance of them taking responsibility for their mistakes. My understanding of the situation is that my friend would be protected under "reserved rights" as where I would fall under MTSF. If anyone can shed some light on this situation, or point me in the direction of any documents that would help then I would really appreciate it, as I don't want to see anyone in the unit being penalised to pay for the management's mistake.

if you drive a tacho omv on duty you get substituted to the mgv grade if you are a opg each time you do it. you are owed this substitution for every time you drove said omv. if your mate voluntarily came off the mgv grade to go on to an opg duty, he should be paid at opg rates.
