permanent contract...

Hi, does anyone know how many years you have to work before you have to he given a permanent contract? If for example you have been having your fixed term contract constantly renewed for x amount of years.

And I dont mean what Royal Mail say it is, I mean the actual law/legislation. Cheers.

4 years.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

As our fixed term contracts are approaching 2 years I believe it is automatically picked up by HR and the conracts are being made permanent.
But it wouldn't hurt to flag it up.

so for say if a fixed term contract was approaching 2 years in September it would be made permanent?

Dont know whereabouts you are in the country but some temp contracts have not been made permanent due to the mail centre closures. Would presume a temp would lose his/her job if someone from a closing mail centre was moved into that office and the temp was then surplus staff.

I was on long term temp contract for exactly 4 years then made perm :crazy:

Well both are a temporary contract so in law thy are treated the same. However, generally it appears in RM a Temporary Contract is open-ended, whilst a Fixed Term contract has an end date.

Both are usually, if not universally, extended or kept on for extended periods though.

and here is an interesting section as regards collective agreements - does the CWU have one and if so why is it not being applied nationally
5) A collective agreement or a workforce agreement may modify the application of paragraphs (1) to (3) of this regulation in relation to any employee or specified description of employees, by substituting for the provisions of paragraph (2) or paragraph (3), or for the provisions of both of those paragraphs, one or more different provisions which, in order to prevent abuse arising from the use of successive fixed-term contracts, specify one or more of the following—
(a)the maximum total period for which the employee or employees of that description may be continuously employed on a fixed-term contract or on successive fixed-term contracts;
(b)the maximum number of successive fixed-term contracts and renewals of such contracts under which the employee or employees of that description may be employed; or
(c)objective grounds justifying the renewal of fixed-term contracts, or the engagement of the employee or employees of that description under successive fixed-term contracts,

No process to go through as I read it. Once the 4 years are up you are considered in Law a permanent employee and have therefore the same rights as them.

Of course this does not mean they cant sack you or give you notice, it means that they must treat you the same as all other permament employees, so you have same rights as they do.

i'd imagine royal mail are keen to keep the workforce as flexible as possible, with the government trying to pimp it out to the private sector. loads of full timers on proper contracts are a headache for the new employer (tupe regulations and all that), whereas if half the posties are out of contract in a couple of months then that makes for a cost-free headcount reduction…

i've seen several examples on this site that supports that theory, particularly in cases where full-timers have been dismissed for relatively trivial misdemeanours after many years clean service.

3.2 Royal Mail employees will be employed on permanent contracts, except where there is a genuine short term need identified. CWU will be consulted in advance where there is any such requirement. Temporary contracts will not exceed two years unless it has been jointly agreed that there are very exceptional circumstances. The position of temporary contract employees will be kept under regular review by the local parties, with a view to converting to permanent contracts where and when possible. Additionally, where change programmes have been completed and bedded in, the status of temporary contract employees will be reviewed and converted to permanent contracts unless there is no need for this additional resourcing or where there is an identified and agreed need to continue with a fixed term contract. Royal Mail confirms that as part of the review of this agreement, it is the aspiration to reduce the length of temporary contracts to no more than one year.
