Hi all,
I found out today that a medical condition I have is covered by this act.Although it has not troubled me to much,thank goodness,does this mean if you have time off work with the condition that you dont get a stage.Or do you still get a stage and if you get to 3 they will take into account your condition so they may not finish you.

Absences, which are incurred by employees who are disabled in accordance with
the Equality Act 2010 and which, in the view of the Occupational Health Service,
are related to their disability, will normally be discounted. However this may not
always be the case and the employee’s manager should always seek advice from
HR Services, Advice & Support and the following should be noted:
 These absences will still be recorded on the employee’s sick absence record.
 The line manager will still carry out return to work discussions, explain that
the relevant absences have been discounted and discuss whether assistance
from Occupational Health Service or Royal Mail would help with disability-
related attendance problems, including consideration of any reasonable
adjustments.
 Absences which are disability-related may be counted where it is justifiable
to do so (and the manager should take advice on this at any Stage under
the procedure ) and in these circumstances the employee should be given
advance warning that future absences will no longer be discounted and the
reasons recorded in writing.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

Define "justifiable" to a Lino or his DIM mate he seeks "advice" under. Weasel words - designed to fool idiots into thinking Royal Mail give a flying f**k.

You can just imagine the scenario.

"Yeah DIM, that Pat didn't turn up, he reckons he's having a bad week, his condition got worse! What should I do?"
<DIM slips on Doctors Uniform>
"Just stage the f****r"
<DIM takes off Doctors Uniform and puts on Golf Uniform>

Usually when ATOS have their backs covered.
The ATOS "specialist" will get the big book of bollocks out and look up your condition,next to it will be a number determining what an Employment Tribunal may consider to be a reasonable amount of sick absence associated with your condition.
Anything above and beyond that would bring a stage warning into the realms of "justifiable" because RM would argue that it has fulfilled it's obligations under the Equality Act 2010 to make "reasonable adjustments" to it's Attendance Procedure.
I know it may be hard to believe but it's not an exact science. :cuppa

Or alternatively the manager doesn't understand the attendance procedure, has never heard of the Equality Act and issues the stage anyway.

It's not enough to simply be covered under the Equality Act...it's for it to put you at a disadvantage or have a serious impact on your day to day activity's... there have been plenty of people who think they are covered under the Act who have been denied at tribunals and coming out with a statement that
it has not troubled me to much,
is making it out that your condition isn't that bad at moment(it could of course get worse and then YOU would come under the Act).
If I was your manager(heaven forbid)and saw this thread I'd think that just because your `covered` under the Equality Act your looking to be continually off or using the act to dodge the attendance procedure. :cuppa

Though it could be that the condition hasn't troubled him too much as he can control it with medication.
