What if one of the partners wants to work over but the other refuses? Does the driver have to drop off the non-driver back at the D.O for his finish time? Does the driver then finish the rest on his own? I suppose if the driver refuses to work over then the lot goes tits up.

Basically yeah you have to drop him back if you want to work over, unless you ring a manager who is willing to pick him up so you can carry on as you can't make someone go over their time who doesn't want to.

Our new duties are due to start in the next 5 weeks and this one of the questions I raised, the answer I was given was, we'll deal with it when we come to it.

The driver would surely have to bring the non driver back to D.O if he/she didn't want the extra work, then the driver would go back to where they were at on delivery.

Sorry guys you are all correct but failed to mention the bullying and intimidation you'll receive when you notify the manager one of you is working to their time.

This can either manifest as how many thousands of letters they are down today, questioning your pace and totally refusing to apply the equalities act (if applies) if you can't move at X speed. They may even try to belittle you with regards to the other person who can do the OT (if they even end up getting paid for it).

The computer says it can be done, of course. I tell them the computer can f***ing well do it then but that's why "my location" is always in the line managers office being screwed over.

I live on my walk and when we get to our finishing time my driver always cuts off .
When we get back to work I get pressured by the DOM into doing the cutoff but it depends what they offer me because if I finished the cut off in say 1 hour they would want to pay me 1 hour.
When the docket kings do our cut off they get 3 hours, so I say to them "pay me 3 hours like you pay XXXX otherwise I'm not doing it. Plus I will take the van home because I am not taking undelivered parcels into my home"

If say a driver says to management that he wants to finish on his time and his non-driver partner wants to work on and the manager says i'm completely fine with that but what i'll do is put you with fred on duty 5 because he also wants to finish on his time and that way both of you can come back on your time no problem a-ok and i'll put his driver on your duty because he wants a bit of OT and so does your old buddy that isn't going to look like bullying to an Employment Tribunal is it?...it's going to look like considerate management.

My bets on he will intimidate Driver A to do the extra and threaten him with a visit to the office if he brings anything back. Quote figures and suggest under performance, if all that fails he will have a big red target placed on his back. Of course this is only what I observe at my DO every single day but it seems far easier to bully than come up with a logical example like yours above that suits everyone.

Bullying is so much easier than using a brain they patently do not have.

I stick up for myself in my DO, one of the few who does. If I get sacked for something, anything, one day for being a pain in their ass, I would imagine nobody would stick up for me. In the Line Managers and DOMS eyes, I am the problem, not the unrealistic workloads, the bullying, the disrespect and total disregard for any illness I am suffering from (Equalities Act).

Its all making me more ill but our union is like an ashtray on a motorbike.

That's not my point Pat.
My point is that is the way that moving someone off their duty can be painted,not the way it actually was ever intended or even occurred,painting pictures is what management do that's why some members think they have a solid case and end up looking foolish at appeals and Employment Tribunals.
If you said to someone Can you move someone off their duty just because they don't want to work over their time? most people would say 100% no...i would refuse to move.
Well you can if you're a sneaky f****r and make it look to someone on the outside like you are doing him a favour even though you're screwing him over.
