IHR/SICK LEAVE

Dear colleagues,
Hope someone can help.Breifly the story goes that I have been on sick leave for 14 weeks with spinal problem.Called to see the DOM today and he has told me that he is starting the process of IHR.He did stress that it was the start of the process and could take up to 9 months.I am a bit confused as I did not realise that this course of action could be taken after just 14 weeks on sick leave.
Also apart from a telephone consultation with ATOS in the early stages of my absence and them sending me for physio after saying that I was un fit for duty, my DOM told me they will not be providing physio because I am getting it from NHS.This seems to be a turn around on ATOS' part as they said they were going to send me for physio.
I told my DOM today I was feeling slightly better,this was before he mentioned IHR.I was hoping to return to work shortly but I am worried now as I dont seem to have a work plan to return as the DOM said forget Atos.Also If I return to work and my back problem persists will I be finished anyway because at the moment I do not want IHR but having said that I do not know how my body will cope on my return to work.And if I have to finish work what sort of pay out would RM give.

tell the dom you are going to see a solictor and he will soon change his mind

He doesn't start a process as such,in his referral to ATOS he asks whether IHR could be a recommendation.
Get him to refer you back to ATOS for a back to work plan if you want one or get back to the docs for a sick note,get your rep and area rep on the case asap!

IHR is 34 weeks pay plus 9 to 12 weeks of 'payment in lieu of notice' and any holidays owed.
The 34 weeks is tax free.
