My sick record 7/12/2007 to 19/12/2007

25/01/2008 to 9/02/2008 total days off sick 28 days
due to an accident resulted back injury on delivery
investigated not my fault stage one not issued both occasions

19/03/2008 to 22/03/2008 3 days off
with back pain caused by the above injury .
stage 1 issued

20/11/2008 to 21/112008 2 days off chest infection
Nothing happen there

1/05/2009 to 2/05/2009
1 day off back pain
Nothing issued

17/08/2009 to 19/08/2009
off work due to stress
been victim racism at work place
investigation and interview took place first interview with rep n DOM got meeting notes
few days after DOM called me into the office I went with rep he said person said to you racist words admitted n will be an apology there soon,
I typed the meeting notes my rep signed as witness that meeting notes true.
Got letter from DOM said No witness there so I cant do anything I still have DOM statement signe by my Rep where the person admitted

16/09/2009 to 17/09/2009 1 day off sore throat
stage 1 issued took my stress related off into the account

11/01/2010 to 16/01/2010 off sick cuz of flu

8/02/2010 to 9/02/2010 2 days off Diarehoea
stage 2 triggered

stage 2 reverted back to stage 1 24/02/2011

4/04/2011 to 25/06/2011 2 absences cuz back pain stage 2 issued
now this year in march faced another accident on delivery
using correct footwear using trolley walking on foot path tried to save myself by a dog walker my foot caught raised pavement fell over landed on my back had witness there my delivery partner manager picked me up took me to the office interview then after i went to A&E got xray done and been told 4 to 5 days rest your back

back to work been told by DOM it was my fault i fell over
then this month in July off to work cuz of flu 4 days wasnt 100% joined duty n still working
last week been told by manager I have been issued stage 3 I havnt recieved the letter yet have ATOS interview tomorrow

My question is have I got any chance to defend in terms of dismissal over above record
any help would be appreciated Thank you for time

As to your question - No idea - but you need the Area Delivery Rep involved as soon as possible. This would be normal for a stage 3 in my office.

Ps Also amended your post to make it more user-friendly.

AOD's should be discounted and the majority of your absences are related to that accident
so you should not get put on a stage 3, as an area rep myself i will say you should be ok if your area rep
does his homework on your absences and links them together

Looking at the information you've provided I'd say that you should not have been issued a stage three. You have not had two absences or ten days in any six month period during the twelve months since July 2011. Your last but one absence was given as 25/06/2011 which was more than twelve months ago meaning that your single four to five day AOD absence was the only absence in that latter six month period of the twelve month limit.

It is extremely important that you verify the dates in your notification letter and those that you've provided us with today.


An AOD is 'not usually' counted towards a stage, this means that the issuing Manager has to provide reasoning for why it was. It appears that their justification was that they determined the accident to be your fault, (probably not taking an expected level of care/attention/precautions).

I would think that you would have to be seriously seriously unlucky to be sacked,but stranger thing have happened.

Was the AOD investigated and have you a report on it,your ADR should be able to help you with that,chances are that part is a white wash.

Thank you all for reply and help. Had my ATOS interview over the phone today ATOS told me they have been asked 2 question
1)if I am covered under DDA?
2)any on going medical problem
Told ATOS nack pain due to AOD on going get good days bad days asked me medication told that
waiting for ATOS report now

You still did not respond to the main issue I raised, in that the dates you provided mean that you should not have triggered a stage and as such no meeting should have taken place.

Hi sorry the date i provided were the right but they took the date when they triggered stage 2 on me
so now done interview for stage 3 and they put me bk on stage 2 thank you for help
