Discrimination? What do you think?
If you worked on a check out in Sainsburys, and because of arthritis in your shoulder you were a little bit slower than your coleagues - (just a little bit), do you think you would have to make up for it by working longer hours than everyone else (unpaid of course) so that you could serve the same amount of customers?
Wouldn't that be disabliity discrimination?
How about if you are a Postie for Royal Mail and you have arthritis in your hips, it makes you a little bit slower than your coleagues (just a little bit) do you think you would have to make up for it by working longer hours than every one else (unpaid of course) so that you could deliver to the same amount of customers?
hmmmm?

Re: Discrimination? Just thinking!
Well you would have to get a doctor to verify you had arthritis and then take it from there.
I always feel like someone is watching me.

Dr and ATOS agree - this is a dda case - relating to a reasonable adjustments issue going on with management

Sorry I'm being a bit slow today.
Well you're half way there but it will take someone with more knowledge than me to answer this one.

Exactly, in your scenario, no it would not be fair or legal. But is this actually happening?zx135 wrote:so is your manager asking you to work extra hours over and above your contract unpaid?toastie wrote: How about if you are a Postie for Royal Mail and you have arthritis in your hips, it makes you a little bit slower than your coleagues (just a little bit) do you think you would have to make up for it by working longer hours than every one else (unpaid of course) so that you could deliver to the same amount of customers?

Run, rabbit run. Dig that hole, forget the sun.
And when at last the work is done. Don't sit down, it's time to dig another one

This is just an average delivery which has been tested by a completely healthy Postie and he can do it in the time, but it takes me a little longer.
Just testing what the general opinion is out there. I dont want any overtime I just want to be able to complete the delivery in the same time as a healthy person would do, but that would mean taking a little off it.

Try and contact your disability champion/Equal Opps rep at branch if they have one, or even contact Linda Roy at CWU HQ she is the National Equal Opps officer. I am sure lapsing part of your duty, or some other change would come under "reasonable adjustments" in the new DDA laws, but they would know better.toastie wrote:This is just an average delivery which has been tested by a completely healthy Postie and he can do it in the time, but it takes me a little longer.

She will either answer your email in one sentence or just tell you to contact your rep.
Oh and I'd have them for disability discrimination, take your pick,Discrimination arising from a disability, direct or failure to make a reasonable adjustment.

Royal Mail managers.....about as popular as a t.urd in a swimming pool!
The DDA/Equality Act demands action,NOT words......adjustments NOT Occupational Health referrals.Case No:2505901/09
Royal Mail is an Equal Opportunities Employer..It discriminates against everybody.
