Hi all im taking a months parental leave to spend some time with the kids over the six weeks hoilday as dom would not let me take any annual leave as it was all gone. Is it ok while on parental leave to go on hoilday was going to take the kids to spain for a week?

Deciding to take parental leave

The purpose of parental leave is to care for your child. This means looking after their welfare and could include making arrangements for the good of your child.

Caring for a child does not necessarily mean being with the child 24 hours a day. Parental leave might be taken simply to enable you to spend more time with your young child. Examples of the way parental leave might be used include:

straight after your maternity, paternity or adoption leave
spending more time with your child in their early years
time with your child during a stay in hospital
looking at new schools
settling your child into new childcare arrangements
allowing your family to spend more time together, for example, taking your child to stay with grandparents

You can take parental leave immediately after your maternity, paternity or adoption leave providing you give the correct notice.

my child is under 5 and its unpaid the parental leave just not sure if its ok to take them aeway for a 2 week hoilday while on parental leave

i have loked at all that my child is under 5 just not sure if its ok to take them away on hoilday to spain parental leave is unpaid.

Whose to know you are off on holiday ? Your not getting paid so why worry ?

Yes you can use it to take them on holiday, it is unpaid, but here's the little fly in the ointment, it can be refused, so the dom may simply use the same reason for not letting you use annual leave and tell you its not possible to take it at the time you want, so just be aware

But the point is this - if he can allow parental leave for that period, why can't he allow you your annual leave during that period.
Either he can cover your duty or he can't.
If he can - you can have your annual leave.
If he can't - you can't have parental leave.

If a manager allows parental leave for that period he is following business guidance and complying with the The Maternity and Parental Leave etc Regulations 1999.
If he allows annual leave for that period he bypasses the collective annual leave agreement and would have to justify why the other 100 members who turned up at his door couldn't have that period without the protection of either agreement or law.
I understand your point that if the capacity is there...it is there but i suspect the capacity is only there because it needs to be as parental leave cannot be refused,only postponed and only with a rock solid business reason.
