stage 2 warning... :(

Hi, just wondered if I have a leg to stand on here...

I've got an interview with my manager on Thursday (21st) after triggering a stage 2. Obviously my rep will be there with me but never hurts to get more opinions. :)

I received a stage 1 last year after being off for 28 days following eye surgery. 1 year and 6 days later I burnt my foot and was off a further 14 days as I couldn't wear the safety shoes required by the company to do my job. This triggered the stage 2 I found out yesterday. Despite clearing a complete year between absences, because it's taken from the interview date and not absence date, RMAP states that I am 12 days UNDER a year.

I'm feeling very harshly done by as I don't agree a stage 1 should have been issued after my surgery, let alone a stage 2 now. And more worrying is that I know I'll be needing more time off for another eye surgery in the next couple of months, which would trigger a stage 3! There's no way I can put it off for a year,I can't afford to take unpaid leave and I don't have enough holiday spare to use that.

Am I shafted??

Yes the year is taken from your STAGE letter and not your return to work.

Under the stage 2 interview you should make this very clear and have the evidence written down. You are unable to appeal but that DOES NOT stop you filling out a grievance form which I would suggest you do. This proves within plently of time you disagreed with the decision there and then and didnt just pull it out of a hat for any tribunal.

No, you are not shafted, yet. If the second stage was felt to be harsh at the third stage meeting, the second stage would be invalid and also invalidate any stages from that period so you should be back on a stage two if you take further time. Fourteen days after a return to work will probably not be deemned excessive though. Still, you did have a clean year after all which should wipe the stages out.

As far as I am aware, further treatment should be covered under the initial stage, folks will be around soon to confirm this though.

But it ALL mostly depends on your DOM. They can do whatever the f**k they like.

What were the dates of the triggers and the interviews.
If they have taken the piss with the wait between coming back and stage interviews you 'may' have an argument.

Eye surgery is corrective and remedial.
Those are mitigating circumstances.
I would not have accepted a stage warning for surgery that was primarily undertaken to improve your ability to perform your duties.
Eye surgery,knee surgery,back surgery...any kind of remedial surgery other than penis enlargement i would argue is to the overall benefit of the business.

How the CWU ever accwpted these stage warnings beggars belief, they want feckin shot. As for managers they just look for any excuse to issue warnings discretion does'nt come into it, it's the satisfaction they get being able to f#ck us over and the CWU can't do anything about it.
