EQUALITY/DDA
I am classed as disabled under the equality act and we are to go ahead with an office resign in the near future. I have had a meeting with manager and rep and we disagree on the process of ring fencing a duty.
1: The manager and rep both say that there are 4 duties that are suitable, so on the repick, seniority will choose first until it comes to the last suitable duty,which will then be given to myself.
2: My take on the repick is that we sit down and agree a suitable duty,,which obviously takes in to consideration my disablement,this duty is then ring fenced for myself,no other duty is taken into consideration.
I would also add that they have not asked what I think my requirements are, and have only considered ATOS reccomendations,which does state the problem will probably only get worse not better in the future.
I have shown them the piece about the National Agreement which was put on here by Fishtank on 16/2/12 but they insist they are correct.
What is the correct procedure 1 or 2 and where can I find it to print and show them?

It's No2.,not much point them setting a side 4 duties to be Equality proof if your left with a duty you can't do.

With the repick in my office, i was told the rounds I was given had been indentifed by my dom & union rep.

Yes i realise THEY are saying it's suitable but you said that they have not asked for your views.

Who is correct, and if I am correct,what is my next option if they are not following the 2010 Agreement.

looking at this, it appears that the only thing they have done wrong is not include you in the discussion, now just a question for you are the 4 duties actually suitable to you?
if they are then you really dont have much to go on as they infact would have appeared to exceeded the requirements, rather than find a job that was suitable they have went further and found 4 and then coupled that in with the repick which the way its being done appears to have also added an element of seniority, so by what you said(and only if the 4 duties are actually suitable for you) they have complied with the equality act and also integrated a system to partly preserve seniority in the office so they appear to have done better than required, but again only if the four duties are actually suitable
if they are going down this sort of route even if they sit you down and discuss it you may find even then they might agree 2 or 3 duties that are suitable and as long as they make sure you get one of these duties in the re pick they have done their job correctly

This is a hugely divisive issue. We had a fairly new entrant 'become disabled' on the job. RM and other OPG's from what I've seen and know appear to have bent over backwards to help this individual but they wanted to wander around the office decide which walk they wanted and then kick the postie who'd signed for it off. There was a lot more of that sort of thing being tried on as well. The walk this person got was way more senior i.e. easier than he would have got otherwise yet they still feel hard done.
Anyway, it comes across as if your trying to do the same sort of thing. If in RM we use Seniority then as long as you get one of the 4 walks then so what? or are you trying to use the DDA to bully your way into getting more than your due?
Sorry if that sounds harsh but I like a number of posties in our office still have a bitter taste in our mouths when it comes to DDA and walk selection.

Sorry I think you may have misunderstood what I am asking, I am not asking if the duties are unsuitable as they take too long, why are they medically unsuitable for you?ie are the predominately stairs etc which your disability would not be suitable for
