Hi,

This has been playing on my mind, the whole ordeal of the do's and dont's of the FFI. That is to say, what is the procedure of these?

According to ACAS, you are supposed to be given notice about your FFI, they are supposed to present the evidence to you in an orderly fashion and explain the exact reason for you being there.

I had a fact finding interview where no questions were asked, only accused. Where no explanation was given, just jumped straight to the first accusation. Where no evidence was shown, just drip fed as though I was being interviewed by the gestapo under a spot light. Finally, where no notice was given to me, I was simply whipped in off the shop floor with no idea as to what was going on.

Surely, this constitutes a flawed Fact Finding Interview and thus means it shouldn't be allowed in my conduct?

ARE WE TALKING A FACT FINDING OR A FORMAL DISCIPLINARY HEARING

ON A FACT FINDING THEY JUST ASK YOU ABOUT AN EVENT TO GET YOUR SIDE OF THE PICTURE AND TO SEE IF THEIR IS ENOUGH EVIDENCE TO GO TO A FULL FORMAL HEARING WITH CHARGES
THEY JUST CALL YOU INTO THE OFFICE FOR 5 MINUTES
EVEN THOUGH AT THIS STAGE THEY DO NOT HAVE TO INFORM THE REP, I ADVISE ALLWAYS HAVE A REP IN SITU
YOU DO NOT HAVE TO BE GIVEN NOTICE ON A FACT FINDING

A,MEMBERS OWN BIG MOUTH IS THE PROBLEM GOING IT ALONE

I ADVISE

NOT TO MY KNOWLEDGE OR
I DO NOT RECALL IN RESPOSE TO QUESTIONS

many an old rep will tell you people hang themselves at the fact finding. name rank and number is the order of the day.

I've already had my fact finding interview, just was not sure they had followed the correct procedure.

As you smash, it's purpose is to define your side of the story however, mine was more like an under caution police interview. The manager sat there accusing me throughout and telling me how the events tool place. Each time I went to answer a question they told me I was wrong and then proceeded to tell me 'their truth'...

Obviously, this is not a real Fact Finding Interview.

However flawed fact findings or interviews are, the appeal stage should rectify any misdemeanour's, that's if there is a case to answer ?

You are allowed to take a rep into a fact find interview and they should really tell you this, but often dont.

The part of RM I work in does have a seperate Conduct Code which states that you have to be given reasonable time to prepare for a fact find, we consider 48 hours reasonable and therefore you would usually get a letter "inviting" you to the interview and you are informed that you can be accompanied by a CWU rep, this allows you to contact a rep in advance and there is less chance of anything been said that shouldnt during the fact find....as said previously you are given the chance to correct any errors during the formal procedure, however, its unfortunate that our code isn"t implemented in all areas of RM as this could save "errors'
