breaks between overtime and nomal shift?

Can anyone tell me if we are entitled to a break between a double shift: say working,

10pm-6am on overtime then
6am - 2pm normal shift.

should you get 5.30am - 6 am as an extra break before you start your normal shift.

if you followed the 11 hour gap you would never do overtime. is it 11 hours before or 11 hours after a shift??
so if you finish at 2pm you can't do overtime till 1am, but then you start again at 6am which is only a 5 hour gap.

Unbelievable,there is 10% unemployment plus those economically inactive, and 20% among the u25's and we have the greedy insanity of postmen/women being allowed to bury themselves by the opt out to work 16 hours through the night and most of the next day with a short break. Bad for your health, bad for jobs.

you would get the 1 hour break for working the night and then the 40 minute break for working the delivery shift. but i believe there to be an agreement which give you an extra break at the end of the first shift before you start the next shift.

Pending completion of the discussions intended to conform with the requirements of the Working Time Regulations, any exceptional attendances of 15 hours or longer will attract an entitlement of 80 minutes.

you are not entitled to 1 hour for working night and 40 minute for delivery shift unfortunately you are only entitled to a total of 80 minutes worth of breaks,

but the 17 week rule is for the 48 hour average, the reason for the 17 week rule is to average out attendance patterns, ie week 1 30 hours week 2 50 hours week 3 30 hours week 4 50 hrs etc, no opt out is requred for that its just if over a 17 week average he is working on average more than 48 hours he needs to sign the opt out, if he is working 60 hours a week week in and out all he has to do is sign the opt out,

also the 11 hour between shifts doesnt apply as he is not being forced to work he is doing it off his own back
