I aplogise in advance. Ive also posted this in the CWU room as was unsure of the correct place.

Hi all. I have a quick question. I'm on a 3 month fixed term contract. Have been for almost a year now. It just gets renewed each time. I want to book some holiday that falls out of my contract period. If I request this holiday does Royal Mail have to honour it as it actually outside my contract dates? Its almost impossible to get any holiday during my contract periods so I'm thinking book in advance now. By refusing holiday outside my contract they are basically telling me my contract will be renewed arent they? Any advice. Seriously considering taking it sick if need be.

I've been refused already my a manager. They said there is no spaces free. Yet the dates I want off don't even run in my contract dates.

you have the same rights as anyone else I would think in reguards of holidays.

just go in and book the dates you want if they are available, and I would think that if you are on "NEW" 3 month fixed contracts that they have to give you any holidays you book as they do honour any holidays you may have booked before you start working at RM.

so I would just book them and take them, you are entitled to the same 22.5 days that we all are.

that's what I thought. Otherwise they are basically sayin im def gonna get a renewel so cant book holidays after my contract expiry.

im also on a temp contract and my lino has been asking me for about a month or so if i want any holidays, i say no because id rather save them for when i need them but this week he has taken the liberty of giving me the week off for next week which i didnt ask for, just dont think they have a clue

If you have been there over a year they have to renew your contract its a new law the government has brought out to stop rouge companies abusing there employees so don't worry about your contract not getting renewed they have too :-)

Make sure they credit you the Bank Holiday

Taking paid holiday

Your employer can only require you to take holiday (annual leave) if they give you the correct notice.

Your employer must often give you notice that is double the length of period of leave they would like you to take. For example, if your employer wants you to take one day's leave, they must give you two days' notice.

Working longer than the contract's end date

If you worked past the end of your contract (for instance, you were kept on for a year when your original contract was for three months), there is an implied agreement by your employer to change the end date. You would then have the right to be given proper notice if your employer wanted to dismiss you.

Ending a fixed-term contract

If you are on a fixed-term contract, generally no notice of the contract reaching its end date will need to be given by the employer. However, failing to renew a fixed-term contract is considered to be a dismissal. You have the right:

not to be unfairly dismissed (after one year’s service)
to a written statement of reasons for the dismissal (after one year’s service)
to statutory redundancy payments (after two years' service)
to a minimum notice period of your contract ending before the agreed end date, task or event

The minimum notice period you are entitled to is:

after one month’s continuous service, but less than two years: one week’s notice
after two years continuous employment: two weeks’ notice if you have been continuously employed for two years

If your contract states you should have been employed for one month or less, but you have actually been employed for three months or more, you are still entitled to the minimum notice period of one week.

If you have been employed for one month or longer, then you must give your employer the statutory minimum notice of one week. If your contract states that you should give a longer notice period than the statutory minimum, then you have to give your employer this length of service.

Just need clarification for people who are affected by this because your post seems to say they have to extended your contract if you have been working for a year. As I read it that's not correct, then should issue you a new contract at the end of the current one, and there are certain implications after 1 year of employment if they don't - however, they can still dismiss you or end the contract even if you have done over a year.

well that would be a first iv been there since last October and an yet to receive a bank holiday.
any week that has a bank holiday i just get that off as a day off but still get my contracted 3 days. and while i could rock the boat about it i am currently working there out of contract
