advice please
long story short had accident on duty 3rd march broken ankle,1st sick note for 6 weeks.i go to thialand on 14th april booked in december 3 weeks holiday put in,iv had my plaster off today the doctor gave me another 4 week sick note,rang my line manager told him iv got another sick note,he told me that i wont get my holiday weeks back because they cant get hold of me(thialand) can anyone shed any light on this,he said they changed it about 2 year ogo holidays and sick are seperate.????????

I was off for 10 weeks with a broken leg. I had one weeks annual leave during and I got that back.

Helpful answer. Could you walk on a recovering ankle for 8 miles? Trust me, some breaks are easier than others to deal with, took my daughter's 6 months to get out of cast, still has pain in it every day :/
Don't know about the original question tbh. If you're on sick, then you shouldn't be going away, you have to be contactable for some reason or another. However if this is at the end of your 4 weeks, you may be able to get a fit note that says amended duties, then take your holidays as planned.

Perhaps the manager wants you to be in just in case he sends you some flowers with a get well card
If you are a full timer and been off for 10 weeks that is £10,000 it has cost Royal Mail so you can see why your manager has said what he has said, not to mention the full timers working harder while you are not at work, I reckon they should have a holiday to Thailand

You should if you can get refund or some sort of and not go to Thailand. Save your holidays for Thailand when your when your a fit. Even when the sicknote ends you'll probably spend a few weeks on light duties. Or even change your holiday.

You could resume to annual leave, to which after 3 weeks in Thailand you should then be fit enough to return to work albiet maybe on re hab hours, or indoor duties, i presume you have already spoken to Atos who should of advised your manager on he next course of action when you return to work.

you should never told the DOM bout hol, the insurance comp will not reinburse you the money for a broken ankle, so go. You will have to loose the hoilday leave cos you told the DOM, but if you can try to say the heat will help the rehab for the injury,
they may allow this, ask ATOS
, but I doubt it. I went on hol, (as it was booked 6 months before)after a op, but on crutches, did not tell DOM
ATOS knew I could not work(on crutches) so saw no point loosing the hol. Just try ATOS to see if this is allowed, as you are not fit for work, especially if DOM says there is no indoor work. I got the hols owed to me

Your six weeks only ran up to your holiday, (04/03 - 15/04), so unless you've provided your Manager with unfit cover for the three weeks holiday then there's no reason to expect it to be paid as sickness absence.
If your Doctor has now provided you with a fit note for the next four weeks and that note prevents you from performing any work then it will count as a second absence and will trigger a stage.
If you have provided a fit note to cover your three weeks holiday then that will help, but as it is a fit note if it doesn't specify that you cannot do any work whatsoever it is your Managers duty to attempt to make reasonable adjustments in order to provide suitable work for you. The Manager cannot fulfill that duty whilst you're in Thailand therefore you would be classed as being on holiday.
If your Doctor has now provided you with a fit note for the next four weeks and that note prevents you from performing any work then it will count as a second absence and will trigger a stage.

His doc has said he's not fit for work, not that he's not fit to go sit on a beach somewhere.
