if following an ATOS assessment it is decided that i can only do a 22.5 hour packet duty would i be entitled to compensation as i'm currently and have been for many years on a 40 hour contract. DOM seems to think that i won't as its a medical issue,his outlook is that if i don't accept this then the alternative is ill health retirement

I would think if you are on a 40 hr contract then you have to have light duties that take 40 hrs , unless it is some kind of fatigue issue.

i would be asking your dom for the opportunity if there is any for a buy down of hours from 40 say to 20 hours

thats only if you are in agreement

the other option is to sign for a 40 hour duty but 20 hours is restructured to all for reasonable adjusments, say locker work for example

the duty is restructured, not you allocated hours under the equality act unless by your agreement

what the dom is saying is that i am unable to fulfill my contract due to medical reasons, therefore the only option is a 22.5 hour packet duty or ill health retirement. neither is that great an option, my condition is considered a disability under the equalities act

There are always other options, IPS, missort run, callers office and add to that the packet delivery and it should easily make up the full 40 hours...........reason is that we have someone like that and they make a 40 hour duty for him based around those things (and add on collections) so you manager is just being lazy and probably heading himself towards a tribunal.


I certainly hope that want too egotisical or self important for some people.

totally agree on the above

the easy way out is IHR so they just replace with a part timer
