Dismissal

I was dismissed 20/02/12 after 10 years of service. I had my appeal today, at 1330. at 1756 I had a text from Atos saying I would be contacted next week for an appointment. forgive me for my ignorance, but I don't work for royal Mail anymore, so should I go? or tell them to fuk em selves, and i'll take my chances at an ET? your comments please. :hmmmm

did they tell you what the outcome of the appeal was there and then?.....if not they might be waiting for atos to report back.
Royal Mail managers.....about as popular as a t.urd in a swimming pool!

It depends on whether you are relying on medical evidence or not, if you proceed to an ET and RM tell the Tribunal that you ignored the appointment arranged for you to see ATOS then the ET Judge would take a dim view of your actions.

Right, Red Robbo that does make sense, but don't you think that they should have sent me to Atos before they sacked me?
I have Atos ( OHS) reports dating back to 2004, and they all say the same thing. I have issues, but combat them with medication, So wouldn't the ET take a dim veiw of RM for not taking the advice of said reports?
Time for Legal Representaion, Me Thinks.

Weirdo your appeal is to look at all the aspects of how your dismissal was established if there is doubt from the appeals manager then that could be the reason for him/her in asking for a medical report, in the meantime submit an ET to cover yourself.

I was Dismissed for Gross Miscoduct, I swore, twice at a manager. I was on a two year serious for similar. Please don't judge me on that. Please believe that I have mitigating circumstances, and I've been tucked right up. But the Law is the Law, unlike Royal mail's Conduct code, which is Corrective one minute, the next Punative.

And, just for your info, I was dismissed without Notice, this February, for an Incident that happened in the D.O last April. The Manager reasoned that if he didn't Dismiss me without Notice, it MIGHT happen again!!!!!!!!!!!!!!!!!

You tell me? I've got Emails from me to them, asking for the case to be heard. Believe me, I work(ed) with untrained, unskilled jumped up postmen, who become managers, and the decide themselves, how they want to manipulate not only the Conduct Procedure but also the B&H procedure.
Some of these so called Managers are not fit for purpose, and I've stood up to them, and they hate it(ME).

Yes, I've been Dismissed, and yes, I'm going through it right now, but I won't give up.

When I recieved my 2 year serious, I had to go to a Stage 2 Grievance to get my Appeal, five Months that took.

I'm still in greivance with RM over the way my pay was stopped whilst on sick because a manager THOUGHT my sick note had ran out. I started this procedure in December last year. Ongoing.

And Both Grievances ( I won the first ) were against the same Dsm, and guess who dismissed me?

And don't get me started about the union.......
