Dog bite...is it worth me claiming

Last Friday I was bitten on the hand while on delivery. I went to A&E and was treated. I have 3 cuts to the knuckle of my right hand. I took the Saturday off of work and have been back in this week on full hours but on indoor duties only. I had a follow up appointment on Monday as well.
The house to which I was delivering has a box for letters on the outside gate but this day had a packet. I could see dog behind a closed gate to rear of house so went to door. There was no reply and as i was leaving the dog jumped at the closed gate a couple of times and opened it and attacked me.
The hand has been sore all week and it shook me up. My DOM says i should have just carded the item but line manager says he would have done same as me. Currently i am not in the union.
What do people think. many thanks

First of all you need to contact the police
Fill out accident form Erica.
Then get yourself in the union ( you never know when this could lead to sickness time off in future)
get a LS form take picture's of hand .

Has lino/dom sent a letter to the owners

it is a weird delivery point issue though.

I have 4 or 5 on my walk where a post box is outside of their property and a beware of the dog sign on 2 of them but the box is not big enough for a packet etc to fit in it.

so are we to P739 it or are we to enter the garden and knock on the door?

perhaps a DIM who reads this could put us straight ( although I doubt any will own up to being one )

First yes you should put a claim in against householder.
Contact H&S rep to contact dog warden
You went into an area that looked safe i.e. the dog was behind a closed gate so you did it right no worries there.
Your DOM should've contacted Police and also stopped deliveries of parcels or anything that needs you to knock the door until the dog is secured.
You need to get a hospital report for your claim.

OK the DOM is right in this one, if the box was on the outside then that is the delivery point, you shouldn't go in if they don't want you to (and they really don't by putting the box on the outside gate), so you should just have carded them and gone on your way.

As for the claim...........as Essex says, join the union and let them see if they can get you anything but I would doubt it, private property with no invitation means you shouldn't enter and as we know from other more serious dog attack cases nothing is ever done.

He suggested the aggrieved party should claim against the householder - legal and above board - also will help educate people.

Then he had the temerity to get the H&S people to alert the dog warden - shocking.

He shockingly agreed that the Postie did everything correctly.

I suppose the really terrible thing was that he recommended the Manager should suspend deliveries.

Then he went beyond the pail and suggested the postie should have a medical report for his own records.

Yes your right its an appalling catalogue of good advice and support, he should be punished accordingly and given the worst possible punishment.

Join the Union .Dog bites can be tricky things,they can cause problems for many weeks apparently,something to do with the wound being easily infected by the dog's saliva
or at least that's what someone told me and thus can take longer to heal than just a normal cut of the same depth.
The Union helped me many times with work injuries and other things and are well worth the subs for this alone.

It Sounds like a genuine accident , Not some misrepresntation of wrong doing on the house holders part.
Get real. If you think that was good advice . Then yes it is time for change.

Might have been an accident, but there was wrong doing on the house holders part by not making absolutely sure the dog was secured away !
all it would take is a bolt, and u can pick them up in a pound shop.
The home owners obviously knew the dog was a potential hazard as they went to the trouble of installing a mailbox at their front gate,
but they couldn't be arsed fitting a bolt or a lock to the gate at the rear of the house to prevent the dog coming out !

to be honest, it about time royal mail faced up to its responsabilities under health and safety legislation to protect its work force

risk assessmants, SSOW, are regular as clock work ignored by managers. when people come into work, they do not expect to end up in hospital in this day and age. if it takes a few people to be prosecuted in either the civil as well as criminal court then so be it if it instigates change.

next royal mail will be calling it an INCIDENT instead of an ACCIDENT on the erica and blaming the postman for the dog attacking him

dog attack are not pleasent and the amount that come across my desk on a reglar basis sugests that royal mail are not doing or educating its work force enough on this matter.

just saying the accident was "just one of those things" and get on with it is not only irresponsable, but not finding out the route cause anaylsis shows complete contempt and i seriously question the motives of any poster who states otherwise
